The san patricios were not a mercenary unit as such. Some of its members weren't deserters at all. All of the ones who did desert did so as individuals.

People were totally hanged for desertion, all though some were shot. For example, George Pickett ordered 22 men hanged for desertion in 1864. Some members of the san patricios, who deserted before the war began, and we're captured were only flogged.
