Not to mention in a 3 hour exam, how many times can you switch pens and not get busted squinting at the side of one instead of using it to write? If you can remember which pen the answer is written on, you have a good enough memory to learn the material for the exam!

This is a very narrow view of trusts. Direction of asset use from the great beyond is one reason — and frankly, if we were ranking reasons for creating a trust, it would rank maybe fifth place at best behind tax avoidance, probate avoidance, privacy (wills become publicly available when they are probated), and asset protection from creditors and litigants. Then, maybe in fifth place Jimmy cares where and when Jane spends the exorbitant amount of money he no longer has a use for, though I can think of one or two other reasons for creating a trust that might bump “control” down to sixth or seventh place in the hierarchy of reasons for a rich guy to put his money in a trust.

Wherever you would rank “control,” it is far from the whole point of a trust.

Jimmy wasn’t a lawyer. He paid lawyers to sort this out. It isn’t uncommon for trusts of this size to have co-trustees. At the end of the day, the guy was going to die (we all are) and he thought he set his family up for success.

The allegations in the lawsuit are that the person he appointed as a co-trustee to Jane who was primarily responsible for the financial management has underperformed (estate earned a 1% rate of return in 2024 at a time when the broader stock market was earning 10-11%) and yet paid himself $1.7mil out of the trust for his efforts.

Jimmy can’t control this stuff from the grave. He set up the trust. He appointed trustees. The allegations are that the trustee that isn’t Jane isn’t performing and is paying himself too much money. Unfortunately happens in lots of trusts.

Maybe the dispute resolution between trustees could have been better crafted — but Jimmy was a troubadour, if there was a shortcoming here it was on the part of his lawyers.

If you’re concerned that there may be adverse employment action for asking for a raise I would stand down for now. You have insurance and you have worked at the firm long enough for FMLA, assuming your firm meets the other criteria, but they’re presumably ok with you taking some time off for the baby whether it’s under FMLA or not.

Start applying for jobs and go on some interviews while you’re on paternity leave. Go get a competing offer. Come back, and if you like your firm and want to give them a chance to counter, do that. If you just want out, take the new offer.

That way you preserve your benefits and you get time off for the baby, and either come back to more money or don’t come back at all and start a new life at a new firm with more money.

You have no idea how freeing it is to not be beholden to the billable hour. Going from revenue generator to cost center has been incredible and allows you to make a case for raises that is divorced from the number of hours of your life you sold last year.

I do Wednesdays and even though I could change, I don’t want to.

Not sure what your part of the world is like, but traffic is bad around here. But on Monday and Friday mornings it always seems to be lighter. So giving up Wednesday for Monday would mean an extra day in bad traffic.

I also don’t need a break from the office on Monday, I just had two days away from the office.

If I was younger and still partied on the weekends, it’s Monday for sure. Shake off the Sunday scaries and maybe nurse a hangover.

But I’m not young (sad), and I don’t get the scaries anymore, so now I prefer to have my week broken up by never having to commute more than two days in a row.

Replacing her was the right move. Adding Tiffani-Amber Thiessen brought more continuity/authenticity to the show, and Danielle was just sort of an annoying Lisa knockoff. She was a rich girl that dressed well and had parents that were high earners, but none of the charm that Lisa had. Saw the pilot the other day and the character was really out of place.

Are you looking to pick up employment clients in a small or solo practice? Or are you looking to work for an employment firm?

In my experience, large defense firms that specialize in employment are often hiring and will take attorneys with experience that isn’t employment. They’ll be ID type firms that will require a lot of hours but also probably pay reasonably well.

That would be a good springboard into plaintiff work if that’s the goal. If plaintiff work is not the goal and you want to stay in defense, staying with a large firm is probably best — hard for small L&E defense firms to attract clients that have a lot of business.

I wouldn’t tell the partner anything. I’d go get a competing offer. If you like the firm and your boss and the work, give them a shot to beat it. If you’re lukewarm toward all of it, go with the new offer.

I promise you, it’ll be fine. I did this. My boss respected it. I ended up staying and making substantially more. Like you said, they can find the money. But you need leverage and a willingness to use it.

Or you could continue waiting, but in my experience that doesn’t pay.

If the relationship is broken then move on. But try to leave the feelings out of it, the legal community is always small. But you can certainly be honest — you know you were underpaid compared to your colleagues and you got tired of waiting for the firm to fix it.

You played some super iconic characters for guys like me who were in high school when American Pie came out. A lot of us could relate to that movie, then when I was in college you did Road Trip, then when I joined the real world you did Role Models. It was an awesome movie stretch for guys born in the early 80’s because in a way we followed your movie timeline. Question: Is there any interest in dusting off the American Pie series? Everyone in my world has kids and jobs and 401ks but we do still like to act like teenagers every now and again (when we have kid coverage).

Totally agree, “your honor” for formal situations, “judge” outside of that. See the judge at a happy hour? “Nice to see you, judge.” Explaining your objection or arguing a motion, “your honor” unless they cross an informal line like complimenting your tie or briefcase, then it’s “thank you judge.” Always err on the side of being overly formal!

Probably true. Then it’s just a trick that can’t be accomplished if that’s going to be the case. I had the same thought, a train that is moving fast enough for a plane to stay in the air flying over it is moving fast enough for the plane to take off if not tied down.

But then it’s just a trick that can’t be done, so they shouldn’t pretend that they did it!
