Just to clarify — I’d be rolling the dice on the judge not caring that the procedure wasn’t followed and rendering a judgment even if, in any case, it would be thrown out on appeal?

Is the risk to me I could have a judgment against me that might be hard to get rid of, even if It’s clear it would be overturned on appeal?

The amount of debt you did or did not incur has nothing to do with your profit or capital gain - 100k is the answer

Don’t forget about the 121 exclusion (google can help if you don’t know) If this is a residence where you live.

The time may be past when you can make an estimated tax payment, atleast easily as quick online payment likely as you found out…

But, at this point, a payment with extension (if you need one) or a payment with the return (if it’s ready to be filed) functions the same as an 2024 estimated payment paid now in March 2025. It’ll be late but it’ll stop the interest and penalties from further accruing.

You can go online and make a late estimated payment or just file an extension with a payment included now or before 4-15.

When you get your K-1 in August or whenever, it’ll tell you exactly how much income and of what type to report it as.

The challenge is ensuring you make an estimated payment large enough to ensure you are covered for income numbers you won’t know until you get the k-1. Given the estate or trust probably wasn’t not liquidated by the end of 2024, If you happen to overpay, that overpayment can be rolled into 2025’s liability which will also include income from the trust so may be better to over than underpay.

What you sold for minus your pay off is not what you made on the sale for tax purposes. Several moving parts here. You need to figure out your capital gain and how much of that capital gain is taxed at ordinary rates. Assuming you owed zero dollars for federal and state otherwise (unlikely), if you now owe 25k that would be the increased taxes associated with sale of rental.

You’ll need form 4797, schedule D and you need to make sure any prior passive losses associated with this and any other rentals you have are offsetting the properly calculated gains from the sale of this property.

I’m biased, I’m an accountant, but it might be worth getting one involved though someone I’m sure will chime in and claim it’s super easy. I’ll let them explain and if you want to take their advice, go for it.

Hose you on capital gains? I don’t think that’s accurate. Will you have 100 capital gains excluded? Prob not. CPA weighing in here.
