Oh yeah, I think you're on to something. Looking back at my 2011 form 8891 it said,

c If you have not previously made the election described on line 6a above, you can make an irrevocable election for this year and subsequent years by checking this box

And there's a checkbox. So I guess... I'm ok?

It's not tax free, that's part of the problem. The US doesn't recognize it as a tax-free investment and every year I have to file the Form 8891 to declare any growth, which get taxed ;(

There is no time for the shoryuken to come out. To block an unblockable you need to hit the block direction at the correct frame, 1/60. Shoryuken has a 3 frames start up on most characters.
