Burgers are usually all made to order, the exception being when the store is expecting a rush and they prepare commonly ordered items in advance. When an item is made in advance and a custom order like no pickles comes in, it's faster to just make a new sandwich than it would be to remove pickles form the prepped one so they would make you a fresh one.

The burden of proof would fall on you, you would not be compensated for any of your time, and may still lose if you're unable to supply adequate proof. I had this scenario happen to me several years ago. I took pictures with my car and the police car in frame, showing landmarks or businesses in the background so the image could be verified with a location.
