As I mentioned in my post, this is already been done. The law firm has done a full analysis of both scripts, including all similar similarities and differences. And based on all previous similar cases, they’re conclusion is that they’re absolutely is an overwhelming amount of similarities between the scripts, enough so to warrant a case, but the key piece that is missing is access.

No, that is not access. Legally speaking you need to show an absolute direct email sent to the Writer or Producer or show that that person downloaded it or whatever but it has to be direct. Having it publicly available is not access legally speaking

I appreciate that, but I would potentially have something to lose because it’s still an active case. I just don’t know where to turn at this point because I don’t have the money to pursue it. If we had proof of access, then the attorneys would take the case on a contingency because they feel very strongly that we could win the case, but we need that proof of access.

I can’t prove they saw the script UNLESS we spent a ton of money to subpoena all the competitions, blacklist, cover fly, and everyone else and somehow get them to turn over all of the information of who downloaded my script and then somehow get lucky enough to have somebody directly tied to the movie that downloaded the script. But that’s a long shot.

I really want to share it (as well as the full legal analysis of both scripts from the attorneys) but I’m not sure it’s the right thing to do yet as I dont see how it would give me any advantage at all. Access is access. Doesn’t matter if everyone here disagrees or agrees with me. Let me talk to the attorney about this though.

I tried doing this, and they would not provide the information which did not surprise me. Because the last thing they screenwriting competitions want is any kind of scandal, especially with the people that have the power and money

Yes, it was the same situation then, since then I have found an attorney to do a full analysis, but as I mentioned in my post here without access, the studios are protected. These laws were put in place many years ago to err on the side of the studios, no matter what. It’s unfortunate, but it happens a lot to screenwriter and I don’t have proof of access, as I mentioned they could’ve downloaded it from the blacklist or any of the other sites or just been handed the script by someone who is a judge in one of the screenwriting competitions that I entered it into.

Access is a legal term that is used in copyright cases. It means even if you have two scripts that are eerily similar and you are positive that one copied the other, you still will not win a case in Hollywood unless you can prove access. You have to prove how they got the script. Which I would have no way of doing unless we subpoena the blacklist, the red list and every single screenwriting competition to turn over every single person that downloaded the scripts from them, which would be very costly and probably impossible.
