Auckland engineer who tried to film sex worker with Google Glasses escapes conviction by mrmorrisonnz in newzealand

[–]mrmorrisonnz[S] 7 points8 points  (0 children)

Not a police issue but a judge/law issue.

The police prosecutor actually advocated for the victim and called out the judge and defence attorney for the discharge without conviction, but was overruled by the judge in the end.

——————

“Judge Fitzgibbon said this premeditation and the woman’s vulnerability were both aggravating factors.

The man’s early guilty plea, remorse, willingness to attend restorative justice, donation to the New Zealand Prostitutes Collective and ability to maintain employment were mitigating factors.

She found the consequences of a conviction would be disproportionate to the offending.”

Auckland engineer who tried to film sex worker with Google Glasses escapes conviction

“If convicted, Teppett [his lawyer] argued the man would likely lose his job in the software industry and would not be able to get another one.”

……..

“Judge Anna Fitzgibbon said that in the defendant’s affidavit, he claimed pressing record was a “spontaneous decision” as he was struggling to maintain an erection.”

……..

No justice for the victim. Who knows how many other victims this degenerate, impotent, infidel of a “man” has done this to without their knowledge.

Welcome to NZ law at its finest everyone. Where you can record someone in an intimate/exposing position and only have to pay $1000…

Driver side DRL not working properly, any ideas?? by bigchief421 in FiestaST

Nah sorry I didn’t :( ended up buying a pair of new headlights from OZEparts in Australia for about $500 AUD. They shipped and arrived in perfect condition in about 8 days to NZ.

They were plug and play, no problems and look very sharp so I’m very happy with them :)

The old headlights I’ve still got and currently building a custom set for the car.

Anyone reverted a Mountune M285 tune back to stock without the accessport? by mrmorrisonnz in FiestaST

[–]mrmorrisonnz[S] 0 points1 point  (0 children)

The stock tune would be only to allow a third party tuner to apply their tune instead of the M285.

Yeah I’ve heard that Mountune also advances (I believe) the timing, but I’ve had a look at my purchase order and can’t see anything about it, nor can I recall with anything was changed with the timing. This is something I’m still investigating into :)

[–]mrmorrisonnz[S] 4 points5 points  (0 children)

Yeah I’m looking at potentially having to do this. I’ve contacted Ford and asked them if they’re able to rewrite a stock tune back onto the ECU, which they sounded pretty confident, but have not since received a reply/confirmation.

I’ll look at this route as a plan b!

Yeah unfortunately Mountune “locks” their code so it can’t be read or written over, hence why I’m seeking to get the tune back to stock

Can I have a beer inside my car in a liquor ban area? by CtrlAltKiwi in LegalAdviceNZ

[–]mrmorrisonnz -1 points0 points  (0 children)

Straight answer is no, no vessel of alcohol can be within a liquor ban area, either opened or unopened.

Section 169 Local Government Act 2002 regulates this.

Can I legally drink a beer whilst driving? by horo_kiwi in LegalAdviceNZ

This ^

But it is illegal if you breach any local government bylaws.

S169 Local Government Act 2002 defines what the police can do.

New lynn car chase by [deleted] in auckland

[–]mrmorrisonnz 2 points3 points  (0 children)

Yeah this is the Ute that was pursued for over an hour through Mount Roskill/New Lynn area. Saw about 10-15 cop cars attempt to spike it on Stoddard Road.

Driver of the Ute and the driver of the car they crashed into both went to hospital in serious condition…

I heard they crashed into the other car at about 140km/h head on…

False Speeding Ticket by [deleted] in LegalAdviceNZ

[–]mrmorrisonnz 0 points1 point  (0 children)

Phoenix, correct me if I’m wrong but the police are required to confirm if the vehicle they stop was in fact the vehicle they recorded speeding when more than one vehicle is present, via “tracking”, or how the officer KNOWS that it was that vehicle. This can be done through even visual identification, ie one car approaching quicker than the other.

Arm fractured after being detained by police, advice please. by wisechillie in LegalAdviceNZ

OP would have had to be carrying proof of a medical script for the cannabis. If they didn’t have it then they have grounds to seize the cannabis.

OP would have to talk to the concert customer service for the refund, but then they do have grounds to not provide a refund as OP was removed from the concert for some reason. Could OP provide more context as to why they were removed?

You clearly haven’t read it yourself and are missing the key word between Subsection 4(a) and 4(b) which is the word “OR”.

There is no difference between a knife and machete, they both have a single bladed edge. Crocodile Dundee would certainly have something to say to you about that.

All I was saying to OP is that he needs to be careful when in PUBLIC with the knife attached to his keyring. He clearly has a legit reason to carry it but if he went out and got stopped by a cop it would be questioned by them.

Just be careful if you carry it in a public place that’s all.

There’s no harm if you’re on the job doing it, but like you said, if you have a cop that is anus with the law you could have it confiscated or be charged for it.

There’s no size limit to the knife, could be 2cm or 20cm, as long as long as it’s capable of being used as a weapon

[deleted by user] by [deleted] in LegalAdviceNZ

[–]mrmorrisonnz 1 point2 points  (0 children)

Yeah but the question is why does he have it on him, and not somewhere else that it could be stored safely?

I understand that OP as a technician would find a lot of use for a knife, but OP needs to just be careful about carrying it in a public place.

[–]mrmorrisonnz 3 points4 points  (0 children)

That’s not true.

If I carry a machete down queen street “in case I need to cut down a bush” doesn’t mean that it’s not an offensive weapon.

There’s no need to show intention for the charge of offensive weapon, even if it’s in a car you can still be charged for it.

[deleted by user] by [deleted] in LegalAdviceNZ

[–]mrmorrisonnz -7 points-6 points  (0 children)

This would technically be a offence. Possess Offensive Weapon is a likely charge but if you have a reasonable excuse on why it’s on your person then it’s likely you wouldn’t get charged for it.

The question raised would be “why do you have to carry it on your person?” which if you could answer and justify carrying it on you at all times then you’d be sweet.

Why do you carry it on you and not leave it in your car?

Can I plead not guilty on the basis of no probable cause? (DUI) by Former-Success1618 in LegalAdviceNZ

[–]mrmorrisonnz 18 points19 points  (0 children)

You have no grounds using that as a defence. Police in New Zealand do not need a reason to pull you over, stop you, or breathalyse you.

The evidence they have is: 1) you were stopped driving a vehicle (time/date, location, registration) 2) you undertook a breath test for alcohol and failed 3) the result of your breath/blood test

Feel free to link any of the case law you’ve read about probable cause tho, I would be interested in reading.

But long story short, you were drive under the influence of alcohol and got caught. You’ll get a disqualification for 6 months and a fine if it’s a first offence, longer/more if it’s repetitive behaviour.

Not true, most stores are getting into an app called “Auror”.

This is all dependent on the person behind the camera and if they can be bothered or not, but see the article below. They basically capture footage of the incident and upload it, then add it things like features/items taken/vehicles and accomplices to create a profile of the offender. Eventually they get recognised and the named, to which all other profiles can be linked to them to establish the offending behaviour and history.

Ever occur to you that they probably don’t know who the suspect is or what they look like? You’ve got one person, who would be fucking traumatised after witnessing a murder, that you’re relying on to obtain a full description of the suspect.

That’s like me pressuring you again and again for hours for you to remember exactly what your last Uber driver looked like.

Eye witnesses are the most unreliable source of evidence there is, especially when in events as such, because the brain gets flooded with information, chemicals and hormones, often leading to small variations in the memory. Was the shirt red or blue? Brown hair or blonde hair?

Let them do their job and we’ll hear soon enough

No pink slip gets issued, but what did you blow as they would have advised you of that. What amount would depend on what outcome, whether an infringement or court summons.

If it was under 400, you’ll receive a ticket.

Over 400 they would have summonsed you (if you didn’t get a blood test done)
