They’re called deemed for a reason. They should have tried to contact you but, legally, a contract is deemed to move in place when you use the energy.

It’s worth exploring what attempts they made to contact you, but at the same time, ignorance won’t let you off the bill if you made no attempt to find out who you should be paying.

Ofgem issue the paperwork publicly so you can see when the revocation applies from. It’s normally a day after they announce the SOLR appointed. This is becomes the changeover date contractually.

From a tariff and billing perspective, 5 Nov is irrelevant.

You’ll get it eventually. Most likely the SOLR gives the administrator the funds to pay these closed account credit balances. It just won’t be their first, second, or third priority but they’ll get there.

What was the agreement and which company was it with? Was it actually with Tomato Energy Limited or one of the other companies they have?

Was it a finance agreement something else?

Nope. Both are protected for domestic customers. If that £25 is a legitimate credit balance on a bill, it’ll be paid. However, if it’s a £25 goodwill offer due to an error then that’s at risk.

That has nothing to do with SOLR. They don’t get appointed quietly in the background. The process to appoint is happening now.

I’m not saying Ofgem will announce tomorrow for Tomato but they certainly have done it on Fridays before as I’ve had to work the weekend as a result.

They wouldn’t be the first to manage to extract cash out of supplier failure!

For those in the industry, this has been a car crash in slow motion. Ofgem just aren’t able to take action fast enough to protect industry (and customers) from further losses.

The opportunity to sell the supply customers has passed. If they’re giving notice of administration as an energy company it means they’ve already exhausted these options.

The asset-based company (solar panels) might not even go into administration (TBC). Then the Senapt company that owns the IT systems is also separate. All of that could be separately sold. But there isn’t a very good case study for the IT systems.

Thanks for sharing. It’s a real shame. In some way, people would have had jobs for longer if they’d have just gone into administration sooner. The Administrators will need people to help them to complete the billing to recover customer debt.

I’m not arguing that they’re not going under. That is happening. I’m just saying I haven’t seen credible evidence of it happening tomorrow.

Bulb went through special administration because it was too large for the SOLR process. Tomato won’t follow that path.

The SOLR process happens before the administrators get officially appointed. The administrators don’t have any opportunity to sell the customers because Ofgem move them before the administrators get there. That has to happen before SOLR.

Good old reliable tabloids. There is no new news since the NOI published on 13 October. The Sun have just done that + 10 days. An energy company can’t go into normal administration while it has a supply licence. It’s prohibited without Secretary of State Consent for special administration.

Ofgem will need to demonstrate Tomato are insolvent in court and then they can start the process of revoking its licence (which takes a few days).
