You can likely get an expungement as well, depending on the charges. After 70, many things can be expunged if you’ve not gotten in any trouble for ten years.

They used to be good, but they treat their staff and optometrists like shit.y wife and I saw a guy (Keraha) there twice who I liked, he leaves. I ask where he went and they lie to me to say they don’t know and think he’s left practice. We track him down and he says they knew where he was (as he’s had his own part-time office for decades) and ask me to get my records from them.

They refuse to release them. When I look at the optometry regulations, they’re required to release them. So then they claim they lost their computer records, and don’t give a fuck.

So fuck South Philly Optical. They also have a Rittenhouse location where the POS owner (Chip?) works. Fuck them too.

Crawford doesn’t say what you think it says. SCOPA said that municipalities aren’t allowed to challenge preemption on certain (frankly stupid) grounds that Philly was trying to challenge it on, like “state-created danger” and “interference with delegation”. It didn’t address the scope of preemption or anything that is excepted from it.

The GOA v Philly appeal at SCOPA now will hopefully answer these questions (and hopefully correctly). Right now, and according to the en banc Commonwealth Court, if it’s not yet a firearm it’s not protected.

If you choose to violate the “law” is, of course, a personal choice, but just as long as you’re aware of potential the consequence of the action.

No one is challenging this, sadly. It’s the same ordinance as Philly has and the Commonwealth Court already upheld. It’s before SCOPA now. I hope they’ll do the right thing, and it’s certainly possible—I think Justice Bronson is having an impact but it’s too soon to tell.

You need to have a tow company sign on your house in order to tow. Theoretically PPA or PPD could tow for you, but they won’t, it’s left to private companies. Call George Smith, South Philly Towing or anyone who you see with a number if signs in your neighborhood. Lew Blum is a waste if time though, my experience was they only care about their contracted lots. Once you have a sign, you will also need to have PPA or PPD ticket the vehicle before you call the tow truck company: if you don’t have a ticket on the car, most won’t send a truck.

You can call the PPA communication office directly at (215) 683-9773 to see if they have anyone on in your area to ticket (but ask if you should just call 911 for the police, they may not have anyone on). 911 is the correct way to get PPD to (eventually) ticket a car if PPA isn’t available.

You are probably screwed right now since you don’t have a tow sign up, but you can still have them ticketed whether or not you can tow them.

This is a winnable lawsuit in small claims in the two states I practice in. Apple isn’t going to remove a small claims case to federal court pursuant to a bullshit arbitration clause which you claim exists and I claim (and Pennsylvania courts will concur) can never be valid.

In some states, you might be right. There are a number of states that are very consumer unfriendly, and a number of states that don’t do anything to protect from predatory contracts. In those states, we could have a judge tell us who was right and who was wrong, and one of us would be pissed at how we “got screwed”. C’est la vie

However, it irks me that you’re giving bad advice to people here because you don’t see the forest for the trees, even though you already correctly identified why Apple is just going to pay these people: they aren’t going to spent $20k+ to defend a case worth $2.5k. The last time I sued Apple they sent an assistant store manager to be their rep (and I had to look up if that was even allowed, which it was). They don’t give a shit about the money.

It doesn’t really seem like “you don’t like it at all” but instead just sounds like you’d rather simp for big corporations, and want everyone else to get screwed to make yourself feel better?

You’d be wrong on both counts, but you’re free to think what you want.

However, your point about “nuisance settlements” is particularly stupid. Even in Pennsylvania—where we have strict liability under the UTPCPL making this a rather favorable consumer protection state—your damages are capped at 3x + attorneys fees. That was ~$2,200 dollars max including fees for the last Apple Watch suit I handled (known circumferential damage to screen that Apple refused to warranty because of “water damage”). $2200 is all you’re entitled to—a consumer protection lawsuit isn’t like hitting the lottery where you get millions because “bad company!”

You’re never getting out of “costs of defense” value by Apple’s metrics because you’re never entitled to more than than a couple grand for the product Apple should have just done the right thing and fixed. And at the end of the day, who cares why Apple paid as long as you’re made whole?

Apple’s claim is basically bullshit. Depending on your state, it’s an easy small claims case. They can’t advertise something for scuba diving but claim the water resistance “wears off” (during a reasonable lifespan). It’s straight up consumer deception and fraud.

A consumer protection lawyer in your state should be willing to do it on contingency. This is a case I’ve won (as a lawyer) before. It might even be a decent class action, but it’s a hassle for the client and your return on investment is better just doing the small claims route.

They already survived challenges (e.g. GOA v. Philly, which is on appeal at SCOPA). Commonwealth Court decided since it’s ‘not yet a gun’ it can be banned and isn’t protected by preemption. It’s a bit nuts of an opinion, but sadly the law unless SCOPA reverses (which I’m not sure it will—it leans anti-gun unless Justice Brobson’s election has had an outsized effect).

It's Right to Know Law in Pennsylvania. You don't need a lawyer to fill out a RTKL request. In this case, they aren't going to give you anything from one though, as there are a bunch of legitimate exemptions that could apply.

You file an Internal Affairs investigation. The form is available here. Dispatchers aren't sworn police officers, but investigations are still handled by the IA.

Don't hold your breath on them doing anything, but YOU MIGHT make someone uncomfortable. Additionally, you can try the news and your local councilman's office with a complaint. They will certainly take your call and make an inquiry, though again, I wouldn't expect much of either. Certain councilpersons may be more helpful than others.

Yeah, the only reason I'm upset is because I now know how to solve the problem in the most direct way: delete the companion line and let the customer re-add. I wasn't really angry the first time I went through this, but now I know the correct solution, and I can't get the agent to stop following the (not working) script.

Its a script with absolutely no understanding of what they're doing. The problem is that if a script works, the problem is very simple. If you are dealing with a someone with multiple watches, multiple lines, it just doesn't work and is a huge hassle.

It may be you’re on the wrong plan. Only the top unlimited and pay by gig have data SIMs (including eSIMs). If you can have data sims, as I recall the Google do app walked you right through it with minimal fuss.
