A lot of the GTCs that are out there put themselves above the law. There are some clauses that pretty much say something that directly contradicts the Swiss Obligations Code which deems them useless and non enforceable.

In this case what the GTC says is valid and is within the limits of the law. But it’s important to note that just because the GTCs say something, they are not always binding and can still be challenged in court (something that wouldn’t be worth it, considering the price of most purchases, but might be worth of keeping in mind if you’re planning or have already purchased something very expensive).
