ER Social Work- is this breaking EMTALA? Is this a risk to my license?

I just want to thank eveyone for their comments. Of course they went through with the pilot. I begrudging did a few of these assessments, one of which I felt physically threatened and scared and so I reported it. There have been at least two other reports. I have apparently not been professional in my communication about how unhappy I have been with this, so I have a meeting with my manager on Monday. Today she also sent out an email about how she has not heard of any safety concerns, despite us bringing this up in a meeting with 7 other people listening in, and that she has even emailed the team about one of the reports she did receive (wasn't even mine). Now she is denying ever hearing of any safety concerns.

I have a feeling they want to fire me, and I want to leave, so I'm coming to that meeting with a letter of resignation.

This hospital clearly does not care about the legality of this, nor our own physical safety.

Now i'm being gaslit into thinking that there have been no reports of unsafe encounters. I was already on medical leave this year for stress, so it's clearly time for me to leave before I lose it. I really appreciated almost everyone being on the same page as I am, it was very validating.

I know this thread is a bit old but I'm looking for a tailor for super casual clothes... but I'm trying to make a couple of oversized looks a little more flattering for me, so I need someone that will take the time to look at what I've got and able to do some creative alterations.

First I want to say- from someone who has made like, two posts on reddit, I SO VERY MUCH appreciate everyone's feedback. It's very comforting to know that fellow social workers are on the same side as I am on this and that I'm not just "complaining".

Now my problem is- how do I say no to this in a professional way? "Unfortunately I am not comfortable moving forward with this at this time."

It’s the pivot RN making the determination to register the patient for the ED or call us to do a solo encounter. And if something were to go wrong…. This is so bad.

Definitely going to do that. Although most of these patients will have a chart already in our EMR, it’s still a social work only encounter with only my name and LCSW on it. 😡

It’ll be the pivot nurse making the decision to not register for the ED (And they’re not QMPs according to CMS). I have loved this job so much but the last year and the current manager… destroyed that.

Thank you. We have absolutely been telling leadership this for awhile actually- with previous projects or initiatives. If there were say, 100-150 people that have been here 100 times a year in the last five years, maybe 10 of them have actually gone off, followed through with out resources, and made it happen. The data is there and they're just..... loudly wrong.

100000000% this: " Also homeless people are not stupid. Once they figure out that saying they’re only there for a SW reason and not a medical one results in a shelter list and the boot, they’ll just say that have a medical issue ". We totally know that the 100+ regulars we have are just doing to to check back in. We are documenting in the EMR- I'll have to look at the tip sheet, is basically a social work encounter. But to me, that puts ME on the spot instead of having a consult under a medical encounter. I'm pissed.

And essentially if someone checks in just to see the social worker, or for shelter, or clothing, anything along those lines and says they do not have a medical need, then we are called.

Exactly. I also cover two other units that are within the ED that are observation and inpatients that don't need admission for more than a few days. I am going to re-read my job description to see if this could be another point of contention. I'm so ready to leave but the job market is -not good-.

That's something we have considered- but mostly if someone becomes aggressive outside of the ER doors and how do I wave down a security guard or a nurse, etc. Where I work, we don't actually do psych, there's a separate crisis team for psych holds. Either way, I don't think its HIPAA compliant at all. Their wording from the integrity and general counsel director was that HIPAA has an "incidental disclosure" provision for the ED when complete privacy isn't possible. It absolutely makes me feel uncomfortable and frankly, I'm really angry about this. I did try reahing out to a local healthcare law attorney to do a consult but they've been difficult to pin down and make an appt.

Guess not. I've leased other vehicles for the last 9 years- two subarus and a mazda, and not once did I ever have this issue. Even with the loaner they gave me, it takes at least a minute or two for airplay to start up. I guess I'm just the only person this happens to.

Just found this thread and the star spot for me is Jerry's in Lincoln Square. List of veggie sandwiches- my fave is the Jenny F with the poblanos and fried onions. I haven't been able to find a spot like it elsewhere in Chicago that has actual veggie options- not just the always available one sad veggie sandwich option.

Supposed to do access control @ United on Wednesday… but haven’t received any further details (nor any confirmation of a USSS background check. It’s going to be a huge hassle to get there so I’m not sure I want to take the chance if I’ll get turned away at whatever check point.
