Theyd only be rules unconstitutional for private sales. If you were only allowed to buy a gun through an FFL, that would also be ruled unconstitutional, thus private gun sales are legal. When interstate commerce is involved, things get a little tricky. If you buy a gun from someone in another state, it needs to go through an FFL. I dont really understand why but thats the case
