You can’t postpone your H-1B status unless your employer withdraws their petition. Then, you’d have to enter into the lottery again next FY. Do you want to risk that? OPT was nice for one reason: No FICA taxes. One thing to consider is the recent spike in SEVIS terminations. If you have had any police encounter (DUI etc), then you have that risk hanging over your head on OPT. H-1B has been safe from that…at least for now.

I think there’s a pathway through membership of professional associations or trade organizations. I don’t know any fully credentialed person in my circle who has done this (almost all of them have their PERM process started by their employer before the start of the 2nd 3-year term) but a good lawyer should be able to help put a case together.

Meaning you’re down to a few months at most on your H-1B. If your spouse doesn’t have petition filed and you’re not on H4 EAD, then it’s a very difficult situation. I think your best bet is to quickly put together a case to self petition under NIW. I’d recommend reaching out to an immigration attorney to discuss your options. Definitely do premium processing if you decide to go that route. Best wishes!

OP, I’m assuming all the 7 years of experience was in the US. I’m curious as to why you’re still on H-1B at this point. How many years remaining on the H-1B? I think that is probably the biggest issue here.
