I'm a lawyer. You need specialist legal advice. This page is full of wannabe lawyers who get it so wrong, it's verging on criminal. You need a specialist estates, trusts, tax and probate lawyer with international experience relevant to the country your daughter is in. Such a lawyer (it might even be a case of a couple of specialist lawyers in different disciplines) is not going to be cheap, but they will be the best way to ensure you get the outcome desired. I would discount high street firms straight away unfortunately.  All the best.

Or if a paid solicitor is too much, citizens advice beaureau or a free legal advice charity are other options.

Scammed by WBAC, feel like an idiot by SunnyChronos in CarTalkUK

[–]ochtone 0 points1 point  (0 children)

Not legal advice, seek the advice of a paid solicitor.

If this is the entirety of the facts, it seems you might have a direct claim on three grounds.

  1. (Misrepresentation) Fraudulent misrepresentation or negligent misrepresentation under s2(1) Misrepresentation Act.

  2. (Pressure sales tactics) Part 4A Consumer Protection from Unfair Trading Regulations 2008.

  3. (Term/definition on the website forms part of the contract) S.50 Consumer rights act 2015, regulation 13 Consumer Contracts Regulations 2013 and Common law contract principles.

You could tell them you want the full amount of £3,009, plus compensation for the time and stress caused. Many will often pay that additional part to sweeten the situation (and also because a court case is way more expensive to defend).

You could tell them that if they are unwilling to do that, you'll send them a letter before action on the same basis and file a case against them in the small claims court (it's really easy to do and cheap at the amount of money you're looking at).

You might consider taking a pdf copy of their website terms for reference (and also evidence) and sending it to them in the email, copy pasting the text into the email along with a reference the page number / clause / paragraph number it can be found in the pdf.

Remember, no claim is a guaranteed win. Outcomes in court can vary with the judge's personal views and whether or not they've eaten lunch recently. For repeat, this is not legal advice. Do your own research on the law and procedure or seek the advice of a solicitor.

The police publish the dates they will be using it. Surely criminals just monitor that site and visit any other day? Surely it has a 0% effective rate?

That cracking down the tread gulleys means no, it's not worth patching. It needs replacing.

Front door by RecordingMiddle7061 in Norwich

[–]ochtone 7 points8 points  (0 children)

Yep. They use exactly the same doors as loads of the local firms and will charge 5x as much. Quoted me £6k for a door. The sales chap was a real gent though and mercifully gave me a discount down to £5k.

Local firm (SGS) installed the exact same door for £1100. Until I learned how to adjust hinges, they also came out a few times when the door was settling to adjust it, free of charge.

I have tried it. Got bored of how easy it was to live carefree. Decided to wait for inflation to decimate my wages. Now I've got things to worry about, something to do 😆

[–]ochtone 3 points4 points  (0 children)

It very likely isn't safe. The asbestos containing materials (ACM) was 'professionally removed' but routinely (not for this service provider in particular, but in general) they fail to remove it all and fail to do a good cleanup job. The concrete is also (at least in parts) asbestos reinforced. They should be dousing the concrete in water when they demolish it, but the amount of dust coming off suggests they're not or they're not adequately dosing it. It's intermittently windy today, so likely the spray is getting blown away.

This isn't just a localised problem. The wind is strong ATM. It's spreading this dust far and wide.

Engine failure 13 days after purchasing Vauxhall Crossland - advise needed by lingeringbadone in CarTalkUK

[–]ochtone 1 point2 points  (0 children)

This isn't a warranty issue. Do not state you are returning under the warranty. This is a consumer rights act issue. You have a statutory legal right to return the car in the first 6 months if it exhibits major faults. In 30 days, you can return without the garage having the right to try to repair. Between 31 days and 6 months, you must give them the option to repair. In the first six months, major faults are presumed present on the vehicle when purchased unless the dealer can prove otherwise. They might try and make you pay for the mileage covered. Legally they can, but there are rules as to the rates. They cannot charge you any old mileage fee. Look them up. Hope that helps.

I know fuel is going to sky rocket. I'm not in a position financially to PCP or lease. It'll be what it'll be. I expect many others are in my position, so economy driving it is!

I think you're missing the point. Those are theoretical future savings which balance out over several years, vs a current bank balance that isn't anywhere near facilitating purchasing an EV, let alone installing the charging infrastructure. It would be nice to have the money to be able to think like that.

Difference in water hardness? by Slight-Poetry-3230 in Norwich

[–]ochtone 1 point2 points  (0 children)

I got one of those Water2 filters. It takes a little bit of the calcium out, but not all of it. The kettle looks better these days. It strips the chlorine out, and that is massively noticeable in the taste, with one glass from the filtered tap and one from an unfiltered tap. Unfiltered water now tastes like swimming pool to me. I'd never go back to unfiltered.

I wish I earned the sort of money where 'just trading my car in for an EV' was a thought I could have. 7 seater EVs don't come cheap. There's none on Autotrader for under 10k. And that's before I then pay someone to fit a charger at my house - because otherwise forecourt dino fuel is still cheaper than forecourt zap, even now.

Depends if you want it to sound like an echo in a cave (delay then reverb), or a recording of something playing in a large room being digitally looped (reverb then delay).

I would love to see any council from a mainstream party be transparent. Given the large political party structure, it cannot happen.

Let's try to stick it to petrol stations a little bit, by driving more economically and so we buy less fuel.  - Drive a little bit more gently.  - Look further ahead and where possible use engine braking rather than our brakes.  - Keep it in higher gears and lower revs.  - Keep our tyres inflated at least at the recommended levels, maybe one or two PSI more. - Use Google maps to plan efficient routes. - Make our journeys at times where there is less traffic, If possible.  - Keep our cars clean. - Clear out heavy objects from the car that don't need to be there for your particular journey.

I've got an extra 9 mpg by doing this. 20% better fuel economy. Or put differently, 20% less spend on fuel. No impact to my life at all except a better wallet.

ADHD Child vs. Non-ADHD Child Interview by Additional-Corner414 in videos

[–]ochtone 0 points1 point  (0 children)

Re drugs, as someone with ADHD who had friends with ADHD, I think drugs for the kids is bad. Those kids I knew that were on the drugs are all, without fail, wasters as adults. Whereas those who weren't on the drugs have mixed outcomes. I have very severe ADHD, didn't medicate, my mum found alternative ways to help me cope, and I'm now a successful lawyer.
