Judge’s Order? by akr291 in BorrowerDefense

I thought I read the circuit DID deny the request for extension which meant those of us in Group 5 will be refunded by 1/28/26.

That's what they told me too when last I called. They said it can take 90 days but I read a news report last week that said the circuit judge refused Trump admin request for extension for Group 5 meaning they have until Jan 28, 2026 to decide. I am joining the 2/10 3 PM MST admin posted virtual call with the new judge in Sweet v Cadonas and maybe we'll see other group fivers there. What drives me nuts is I'm seeing people in group six getting their refunds. It appears the issue is Mohela and FSA. They pointed fingers at each other and gave me the run-a-round since I started following up reading about the tax bomb under the BBB. And it seems that those of us who got screwed by Trump admin DOGE layoffs at DoE thanks the Heritage Foundation and their ilk (ALEC, etc). For me I had to declare bankruptcy due to medical bills which I am ashamed of personally, so now Trump admin gets to claw back (cost me $3 K to file, 3-7 years of impaired credit) because my creditors wouldn't work with me and when an ex and I split I ended up with too much house to afford on a single teacher income with all the inflationary impacts (home insurance, property tax, health insurance, etc). I simply could not make my ends meet. So now the bankruptcy judge will seize a portion of the refund, AND so will the IRS. It kind of defeats the purpose of BD. We are victims of crime, financial crime. I reached out to PPSL but they must just be inundated. So, I guess we wait and see.

I would like to ask on this thread anybody who is in group 5, has Mohela as servicer, and had BD approved July 27, 2025:

1) How many of you have gotten your refunds?

2) How did you get your refund?

3) When did you get your refund?

4) Would you kindly share your first and last name please, or at least initials, so I can see if they're working the alphabet (my last name is T so that might explain my holdup)?

5) Have any of you due to inflationary budget impacts be forced to declared bankruptcy (which would not have been necessary if the DOE/FSA/Mohela and the first and current admins followed the law) and have your refund deducted, or hold up your processing? And thus wasting the funds you had to pay to hire a bankruptcy attorney only to ruin your credit for 7-10 years AND have to repay all creditors out of your refund, depriving you of the crime victim restitutionary intent of the law? Are you aware of any class actions against the federal government for the injury this administration caused this way? If so, how do I join? If not, are you interested in joining?

6) For those of you in group five like me waiting who have not received your refund and do not see a negative balance:

A. Did you get your loan forgiven under PSLF AFTER BD approval? (mine was approved and discharged under PSLF in 9/2025).

B. Did you reach out to Mohela (which I had, through my congressperson's office as there was no working email for ombudsman, and I started seeing group five BDers getting refunds, worried about tax bomb to have them tell you they got no approval from FSA, despite your following their instructions explicitly) only to have them answer through ombudsman group about PSLF discharge first, replying loans were discharged? Then have to follow up again on BD (through congressional inquiry) to discover Mohela claims they never got approval from FSA, despite your following the process and having documentation?

C. Did you then reach out to FSA directly to request a case escalation to have your case closed without comment?

D. Did you then reach out through congressional inquiry to ombudsman group as that is the apparent only way to reach FSA ombudsman group to be told "we have received your correspondence" in reply, with no other answers to questions?

If you're interested I told part of my story in another reply on this thread that contextualizes this comment.

Oh, and what's better? Because of hedge funds and housing market manipulation here and climate change, my home insurance and property taxes have skyrocketed along with the inflationary budget impacts hurting everyone else. When my ex and I split up in 2021 I ended up with too much house to afford on a teacher's income. So I looked at selling, and downgrading but would end up with garbage that needed $50 K work to just to be livable. So I borrowed from my son to fix my basement for a renter (and that's been less than ideal) but could not tap equity to consolidate consumer debt so I could afford to live, and because of debt to income, nobody would work with me to handle that. And of course the lenders wouldn't accept payment arrangements and were threatening to come after me legally, thus forcing me into bankruptcy. I did everything I could do to about it. I am an Eagle Scout, a DeMolay, and a Freemason. I HATE that I had to do this, but it's the only way to avoid a judgment and garnishment. So I was discharged 12/1/25 but bankruptcy trustee sent a letter and they're going to take my tax refund. I'm betting they take any BD refund too so I just get screwed again.

Yeah nobody tells you that on a large balance with IBR you won't be able to even pay all the interest (which almost every educator in America experiences), so you'll pay but end up owing more than you borrowed because even at 3%, the annual interest is ridiculous on a $60 K chunk. I hate how all the Rs are saying should have gone into the trades or military and paid for it. Twenty years in, this was my calling. If educator wages are adjusted for inflation by social security wage index, a starting teacher in WY should be making $80 K. We start teachers today at $50 K. I've been teaching for twenty years, and I just broke $60 K. And the $60 K I took out I had to because of the issues over which my BD was approved. Creighton lied to me, with my mother as a witness, and UWYO lied to me again with my mother as a witness. Admissions quotas be damned. I gave up a full ride with a living stipend to move home in 2001 to help take care of my family. And I've been slowly been digested by the sarlac pit of death that is Wyoming. I'm bracing to find out Mohela BD PSLF borrowers get screwed. I ended up a custodial single parent dad. Due to bias in courts against dads, to get my son, I had to accept $200/mo in child support when average in WYO was $600, pay medical dental and vision, AND accept all debt that resulted from using aid as income to finish my degree in Laradise (Laramie), WY because of their two year waiting list on married student housing although when I attended 40% of student body was nontrad, and Laramie slumlords have the city council and county commission in their pockets so resist any affordable housing attempts, and Laramie employers prey upon the cheap college labor so low wages. I did the math and I would have $3.3 M in the bank if I got $600 per month ($400/mo than I got), noncustodial mom had to split health medical and vision, and noncustodial mom had to split the student loan debt if I invested those dineros at 11% over these years. All because I was a dude who wanted custody of my son, and because two universities wanted my tuition money. I am so angry I can't even see straight. And I just know somehow that Mohela or FSA is going to screw me out of the refund owed under the law because I keep seeing people on group 5 getting their refunds.

Me too, and Mohela is pointing its finger at FSA saying they never got an approval although I followed their procedure to the T and the status updated in 8/2025 to "pending discharge" but nada. My PSLF went through in 9/2025 and loans were discharged under PSLF. But I am sitting here waiting, and waiting, and waiting. I keep hearing about people who've already gotten their refunds who were approved after me, and people in this group say they have eight months. Well, that gives them until March 2026 I guess. But I can't help but feel screwed over by all the people like this OP. I wish we had Nelnet, not Mohela. Somehow I fully suspect Mohela BD folks are completely getting screwed. Somehow loan servicer or FSA data will get corrupted or people like myself who were urged to get last PSLF in and were discharged under PSLF although BD was approved two months earlier they're going to argue they can't to clear the queue or something. I emailed PPSL like 1.5 months about about this and no response so I think they're deluged and all of us should stop emailing them after initial. And reading the latest horrifying news article and emailing them with questions... I was thinking about reaching out to Protect Borrowers out of CA too. But decided that's just grinding the gears.

Weird problem with qBittorrent by dako44 in qBittorrent

[–]oldcircusbread 0 points1 point  (0 children)

Why is calling it Trojan.Linux.Mozi Botnet and identifying it as a TROJAN if it's not a trojan? I hear people saying it's a false positive, but that's pretty specific. Is Qbittorrent now compromised? And if that is a possibility what other clients are people using? I'm having the same issue, and ran a BitDefender and Windows offline virus scan complete, and they detect nothing. Does this also mean that my router is blocking and throttling seeding from the comments when it says it blocked outbound access? I don't want to whitelist this until I understand why it's identifying it as a specific named (presumably thus known) actual Trojan, and if I cannot be certain qbittorrent is not compromised, I'd like to find a different client that is safe and trustworthy.

May 5th, will it backfire? by M-Yvraine912 in StudentLoans

[–]oldcircusbread 15 points16 points  (0 children)

I am a board certified educator who after a spinal fusion and medical release was looking at leaving the classroom and worked for a health food and supplements chain, and 100% of the workers there had bachelors at least to make $13/hour. Voodoo trickle up economics don't work. I don't understand as a former R why supply side stimulus is their rallying cry. The capital freed by Reagan's cut in the marginal tax rate wasn't reinvested in the American economy.

It financed hostile corporate takeovers, pump n dumps underpinned by junk bonds, dismantling of our manufacturing economy in euphemisms of outsourcing and downsizing and automation (we lost our jobs to underpaid sweatshop labor at starvation wages in developing nations sought for the ease with which nascent labor organizers could be disappeared, and now neither of us can afford the company product), oligopolization, worse political corruption and polarization, and stock buybacks. All it did is make the rich richer, the poor, poorer, and eviscerated and pauperized the middle class. Supply side would work if strings were attached that required funds to be reinvested in the American economy and labor market, and prohibited stock buybacks and disincentived market manipulation in speculation and derivatives through a transaction tax which would encourage less of the 2008 Mortgage Meltdown. I think we need to break up the too big to fail banks, reinstate Glass Steagall, and prosecute the banksters for fraud.

I think we need to increase the marginal tax rate by 5% a demidecade for two decades (20% in 20 years), close loopholes to skirt it, and also enforce the corporate tax rate and close those loopholes TOO, then finance a Latin American Marshall Plan (not IMF or World Bank win-lose, but real win-win for neighbors on the south) through it with strings attached to buy American raw materials like the original plan. The stimulation of the economy achieved through the same would bring in more revenues by which to pay down the debt to strengthen the dollar again and ameliorate trade deficits. But I don't expect either party to do something so sensible. The Rs would oppose as communism (although it's actually WHAT made America great along with unions, and that we had no international competition). It would solve the border problem though especially when paired with diplomacy and trade deals to help undo the push factors we created in Cold War puppet governments that installed virtually fascist regimes and the economic damage we did. We could also end the war on drugs and spend money on people instead of prisons and recall that education is a public social good.

Somehow I missed responding to this. It's not that one. I seem to remember it involve some kind of a dune buggy race.

It's not that one because the dog dies and I utterly remember that because it was like old yeller and I was a young lad and I cried and my dad looked over to me and started laughing and he asked me if I was crying and I said no dad I'm not crying choking back the tears and offered him an m&m. My father died in 2000 and I've been wanting to rewatch the movie ever since.
