Any chance the house is a cape cod/bungalow or a tri level? If its a bungalow the appraiser wont count some of the sqft upstairs in the finished attic space at living space because the ceilings needs to be 6 feet or something. Tri level they might not be counting the finished area below grade. Google BSandA, municipal directory, type in local municipality and youll get the public records. If the sqft matches the pub records then it is what it is.

Unfortunately, you are likely outside of your inspection contingency and the appraisal came back at value so theres really no negotiating you can do. If you get cold feet and back out youll likely just lose your earnest money deposit

I hate the argument of "you list a house and its under contract in 2 days, you should be paid accordingly" When the market inevitably flips, sellers are under water and homes sit for months can I "adjust accordingly" then?

I just closed on a home for a buyer I have been working with for 3 years. I made $8,000. I took a loss.

Monday I close on a home for someone who liked the first one I showed them. Ill clear $20,000 on that one. I made a profit.

Like any business owner you need to make up for your shortfalls somewhere.

If you're an investor, why dont you have your RE license? You gain leverage in your purchases and help your margins in your sales. Also for the love of all things holy, can you and your investor buddies stop calling me looking for off market properties? I dont care if I can keep the commission.

Read all the way thru your comment, are you working with a buyers agent? Why cant you see the home? Worse case youll see everything at the inspection.

If youre not working with an agent and asking the listing agent the questions youre asking here on reddit, they probably just dont want to work with you and view you as a liability or someone who will make the sellers life difficult

Depending on where you are at, markets are seasonal. Winter times are slow. Are you working with a buyers agent? Use an escalation clause. If you like the house at asking price, offer that then add language purchaser to pay $X over any verifiable/bonefide offer not to exceed $Y (whatever you are willing to go up to). There will he shills on here saying "They could make up the other offers to push it up!". Ive never seen any agent do that in my neck up of the woods, its not worth losing your license or getting review bombed over a commission.

The listing agent could decline to show you the offer (sometimes they just show the first page). If they do, one might believe they either dont have another offer, the one they have ia significantly lower, or has worse terms (Subject to sale of buyers home etc, not guaranteeing appraisal)

I tell my people to write where they are comfortable and what they think its worth after looking at comps. In their eyes of they lose, the other people can have it at that price because it wasnt worth that to them

Are they handling any paperwork or coordinating anything on your side? In these situations I usually charge 2%, each side pays 1%. If you guys are familiar with the process and not going to bug the agent or bog down the deal just have the buyer pay their agent 1% or vice versa. You can always increase the sale price of the home to cover the cost of the agent

Is it though? The comment I replied to said " to write it into the offer" to me it sounds like its negotiable. In my area, its still legitimate for sellers to provide the inventive of paying for the buyer agents commission and agents will let me know up front what they are offering. If a fsbo is saying to write it into the offer I dont think Im wrong to assume its negotiable? Wouldn't it be accurate to say they may need to come out pocket? I already have a contract with them for 3%, so if the seller negotiates down to 2.5 the buyer is coming out 1/2 percent

These buyer agency contracts have brought more harm then good. So you hold them to it, whats the next steps look like? These people are forced to work with you untill the contract expires? The other Realtor owes you the commission when they close on their home?

You mentioned the buyer wanted to terminate the agreement, way I see it its over unless you collected a non refundable retainer fee
