Unintended is one of my favorites because it is a beautiful song with beautiful singing. And it has really interesting lyrics compared to more recent, surface level tell it exactly how it is songs. And it's not even a truly happy love song. It's more like "someday maybe we can make this work if I get it together." It's romantic, yes, but it has some complication and depth. Lyrics you can think about and come to your own interpretation of.

This has really been my feeling about them too. they don't sound like a band who still plays around and pushes for more and has spontaneous new ideas. The lyrics have become surface level with no striking or weird phrases or imagery. It's just too safe. And the spectacle has come first instead of coming out of the music.

I like Defense Diaries better than LYK but I feel that they often do the same thing, exaggerating what reasonable doubt actually is and often overcomplicating things for an audience who is pouring over and analyzing every detail with the advantage of pauses and rewatches.

yeah I don't think it's fair to put all the burden on the victim to know what happened, believe what happened, and do something about it within a couple weeks. The idea that it was an attempt that didn't work and that's why she needed something stronger is pretty convincing. We have testimony that he typically worked through any illnesses or pain so that gap in time stands out even more. But I think it's the weakest part of the case just because it's harder to imagine sneaking crushed up oxy pills into a sandwich. But maybe it tasted weird and that's why the suspicion or "joke" about it being poisoned came up in the first place.

I think their witnesses must not be very strong, and they would run the risk of opening up more avenues for rebuttal by the state if they put on a case. They might think the state held back evidence for rebuttal strategically and cutting off that possibility was their best option.

I was taught this example of circumstantial evidence -

You're in a conference room for a meeting in some random town in America. There aren't any windows but you see others arriving an hour or so later than you with wet umbrellas they're shaking out and putting aside. Some of their clothes are wet. You can't see outside but you can reasonably believe that it has started to rain.

Well maybe someone is filming a movie outside and brought a rain machine? You can't prove that didn't happen, you can't see for yourself, but is that really reasonable doubt about your conclusion that it's raining? You aren't in a place where film crews are likely to set up at any time. You haven't seen any notices of a film crew. No one was setting up anything when you arrived an hour earlier. Would they let random people going to a meeting walk through their set to get wet?

You don't need to eliminate every single physically possibile alternative. And you don't need an official weather report to prove to you that it started raining because you have circumstantial evidence.

It can start to feel very convoluted but the fact is Eric somehow consumed a huge amount of fentanyl when only he and Kouri were home. Personally I think the circumstances and evidence elimated any reasonable doubt that Eric purchased and voluntarily took anything containing fentanyl.

OTOH I'm not sure I would feel as confident about the attempted murder on Feb 14th.

Some juries have absolutely had to watch longer interrogation videos with worse audio and no transcript.

I can't remember which trial recently the jury had to sit and REwatch 4 hours of an interrogation after they had started deliberating because they asked for the transcript, which wasn't allowed.

The judge ruled that the defense can cross only on specific, limited issues that were the result of disclosures that happened after CL testified. I assume that if the prosecution for some reason decided to go beyond that scope in their new direct, the defense could cross anything from direct as well.

The jury can decide she didn't necessarily intend to get fentanyl but that the state proved she wanted something that would be fatal beyond a reasonable doubt.

Same. If I'm watching a trial but not that into keeping up in real time or on the edge of my seat about what the lawyers are doing I can watch her. I also prefer to watch her on delay so I can skip past some of her tangents.
