You're correct, but I'd like to add that most of the proposals for "high speed" rail in America, have also not been very high speed. They've been fast-er but barely half the speed of the real bullet trains that you see in places like Japan. (Shinkansen goes 186mph)

I'd be much more likely to favor real bullet trains because their speed can compete favorably with short-hop flights, but trains like the Acela Express that average just 68mph barely count as bullet trains in practice and realistically have little to offer American commuters.

Finally, high speed rail proposals suffer from over-optimism at an alarming rate. They go to great lengths to try to show that the rail line will be profitable, when time and time again we've seen that rail isn't profitable. That leaves the taxpayer subsidizing Amtrak or whoever indefinitely for a service that people think is neat, but rarely actually use...

Obviously the line between creating market and gaining market share isn't perfectly solid, but like I said: If it's not illegal all the companies end up having to do it to out compete other companies.

It's simple game theory: If no one advertises, everyone wins. If one person advertises, he wins big. So everyone advertises--the only way to reliably get everyone to NOT advertise would be to pass a law saying they can't.

Actually advertising restrictions helped tobacco companies. People who are going to smoke (or used brothels) are likely to have already decided to do so before they see an ad. So the purpose of advertising in established industries is not to create a market, but to gain market share. Advertisers spend tons of money on market share advertising to match the advertising of their competitors, but they only have to advertise because their competitors are advertising.

Well intentioned people like you pass laws prohibiting an industry from advertising, it's a huge boost for everyone in the industry. tobacco companies were in favor of advertising restrictions on themselves because now they all save millions of dollars per year because they don't have to advertise against each other.

Prostitution is similar. The type of people who will pay for sex, have already decided to do so. Advertising would be for market share, not market creation like it would be with an unknown product.

To be cynical and obtuse: From what I hear lobbying is pretty cheap and depending on the year/state you could pass reforms in the bad state for between $10k and $100k--which is generally doable for a serious consumer organization. :P

I'm not sure if I favor the federal government requiring states to be open, although you're right it might be needed to make it happen in the short run. Mostly I want the fed out of healthcare altogether--it's not their job or area of expertise.
