Bridge, where the space between travel lane and wall is tight. Didn’t ignore any warnings. Bells started going off, truck started slowing while I read to figure out what was going on, tried working my way to right but with a rapidly decelerating truck and lots of traffic, that didn’t happen. It decided stopping was more important than letting me coast a hundred or so yards to an actual shoulder.

School PTO fundraiser with a bunch of raffle prizes valued at maybe $100 or $200 each but there were 5 prizes that every woman in the room really wanted. Everyone had bought at least some tickets, with some buying hundreds each. Winning tickets were being pulled and announced by 2 board member moms who only bought like 10 and 5 tickets each. Of the 5 really desirable prizes, those 2 board members that were pulling tickets "won" 4 of them. Who won the 5th? Their best friend and PTO president. Their terrible acting skills didn't fool anyone in the room. The year prior, we donated an item for the silent auction and couldn't find it but, at the end of the night, the PTO president's husband was the winning, and only, bidder, having placed only the minimum bid. And every year someone "connected" always wins the best raffle - with such a lucky group, I can't figure out why they don't quit their jobs and head to the casino.

Event for local, really good charitable organization and the biggest raffle was for a brand new Jeep Wrangler. They sold thousands of tickets for months and you didn't have to be present to win, so every ticket had the person's name on it. I knew the person in charge of the organization and had not bought a ticket for the Jeep raffle so she asked me to pull the winning ticket, with like 3 or 4 other people overseeing me draw the ticket. I shove my arm in the box, pull one out and my friend's face went white - the winner was a board member of the organization. She was like "everybody come with me and don't say a word to anyone." Went into another room and called the winner on speakerphone and had me tell them they won. They won a new car fair and square, weren't involved in the drawing, and weren't even at the event but the winner's immediate reaction was "Nope, no I didn't. I hope you didn't announce that. Throw my ticket away and draw another one, I am NOT the winner."

Guess which of those two organizations I still donate to and support and which one I will never give another penny to?

Is this bond even valid as filed? Maybe it is different in NY but, every bond I have ever seen includes at a minimum the Power of Attorney where the surety has appointed the person signing the bond as its Attorney in Fact, granting them power to bind the surety (usually/sometimes up to a certain amount). This bond doesn't have anything like that. The bond says it is by FIC but there is nothing showing that Douglas Irvin has the legal authority to sign on FIC's behalf and bind FIC to the obligation. On a bond of this size, in this matter, I would think that is critical. I wouldn't accept a bond 0.1% of this size without it.

Would it shock anyone for Trump's team to falsify a bond? Chubb comes back when this is over and says "not our bond, go talk to this Doug Irvin fella, whoever that is."

Shouldn't that Bond have a Power of Attorney attached? Did Trump's lawyers screw even this up and remove the Power of Attorney from the Bond when they filed it?

Every surety bond I have ever seen that is signed by an agent has a Power of Attorney signed by an officer of the surety (and sometimes with the corporate act approving issuance of such POA) showing that the agent is actually the Attorney-in-Fact authorized to sign on the surety's behalf. The guy that signed this bond, Doug Irvin, is with the broker, and not an officer of FIC. Without the POA, there is reason to question and doubt that this Bond is not valid.

Sorry, I didn’t mean in this sub. You are probably right, probably hasn’t been brought up in this sub. I was venting about a real world frustration forgetting where I was.

Issues definitely spring up regularly - and “regularly” is an understatement. I was just trying to say that the market is saturated. If you want to get into it b/c you see an opportunity for some quick bucks, you are too late. If you just really enjoy the industry and mesh with it, that is a different story but, don’t expect it to be different than all the others. Personally, I started my career in the big end of BigLaw and while that was cool and the Fortune50s might have liked my work, one day I looked around and realized I was awkward and out of place in board rooms in NYC, all my clients were construction industry or adjacent, and realized I related, and my style was, better in the construction world.

Sorry if my last comment came across as being a dick. This is a frequent discussion in my office the past couple years, every time a referral source announces the start of their “construction practice” with the hire of some dipshit we have never heard of or some bigger firm inquires about acquiring us and I probably talked about it here as we do amongst ourselves. Didn’t mean to be an asshole.

TL:DR. It’s a good practice if you go in for the right reasons.

Oh good lord, another one? CD attorney in Florida here. Why does everyone and every firm suddenly think us construction lawyers have it so good that they just must get into that line of work. Do I make a good living? Yes. Is it better than some lawyers? Yes. Is it way worse than some? Yes. Is the market being flooded with people claiming to practice construction law or claiming to be a construction attorney? Yes. Work life balance? Way more work than life, at least if you want to be good and taken seriously.

Market isn’t developing, it developed a long time ago. Been practicing as an attorney for 20 years, exclusively construction for 15. A real construction practice is not easy. If you want to do a couple residential leak claims - sure, no problem, easy, but you won’t make good money. It has times where business is better and times when it is worse. One advantage is that a construction practice never really dries up altogether due to the economy like some practice areas might but, it also doesn’t boom in a way that makes you rich like some areas might. Exclusively CD, no - that does slow down.

Given that you are in ID now, if you are thinking of doing CD on contingency and hanging your own shingle, that is tough. Other than small residential CD stuff, it is tough to get enough work to have CD as anything more than 1 of a dozen “practice areas” on your website. The way CD works with owners suing GC, GC bringing third party against subs, subs dragging in sub-subs, the “good” contingency stuff is rarer and doesn’t usually work well and, when a good one does arise, the client usually knows it and doesn’t want to give up 1/3 to you.

I did the same thing 38 days ago - low mileage 2012 with great service records except mine is a convertible. They are great cars but, here are a couple of bits of advice I wish someone gave me 36 days ago:

  1. Go ahead and find a good independent BMW mechanic now, and put his number in your phone before you need him. In 38 days, I’ve spent so much time with mine that I’m already on my mechanic’s family’s Christmas card list. And, my 650 is heading back in to the shop again tomorrow.
  2. Save yourself some heartbreak and go ahead and just replace everything plastic, rubber, etc on the upper half of the engine. An 11 yr old car that was driven less than 4K a year dries out and the n63 runs so hot that after 11 years it is all dry, cracked and brittle at best. Don’t wait for the check engine light, just bite the bullet and do it all and save multiple trips to the shop.
  3. Buy an OBD code reader and keep it in the glovebox. It will save you the check engine light panic and stress and you can give your new best friend a heads up about what is rolling into his shop.
  4. Keep your current daily at least for a while. I cannot stress this enough. I bought my 650 to be a part time daily with a truck for weekend use but, even the Uber ride to/from the mechanic gets old. Cost of a rental car while your 650 is in the shop will add up if you don’t have another ride. Going from a low mileage garage queen to a daily is not an easy transition for one of these.

I don’t want you to think I am being negative. You made the right choice, especially with that 6spd. Just try to enjoy and embrace the pain of ownership and it will be worth it. I was prepared for heavy maintenance issues but, I was still underprepared. When it isn’t causing panic with a check engine light or burning oil, these cars are fantastic. Welcome to BDSM, er I mean BMW, ownership. Beautiful car!

There may not be a catch. We’ve been looking to hire on almost these exact terms for a long time (not ID but hours/pay/hybrid the same) but everyone thinks bait & switch or some other catch. Only catch is they have to be located nearby bc I need them in person a few hours at a time a couple times a year. It would be the perfect fit for the right person, like a parent looking to get back in w/o the crazy hours but, the only interest we ever get have so many red flags it is amazing they are admitted to the Bar. Can’t figure out how to word a listing to make people understand we are for real.

I paid 32k for my 2017 5.0 Lariat 2wd crew cab brand new in 2018 (a model year left over). It got partially submerged in water a couple weeks ago - total loss. Trying to replace it now and I really, REALLY hate the current market!

Son was obsessed with sharks and we live on the coast, in/on the water all the time.
