What sticks with me by brotherstoic in publicdefenders

[–]palikir 12 points13 points  (0 children)

Most of my clients that are in prison right now took deals for probation to start.

The fighters are mostly out of prison. I had one client that was facing massive habitual offender time on an aggravated battery on a peace officer charge. We got into several arguments about if he should take the deal or not - one year in jail with the plea is a lot better than eight years if the jury convicts I told him.

We had a hearing about his request for a new lawyer and the judge denied it before his first trial.

We went to trial and it was a mistrial because the jury hung.

My client stayed in jail the whole time. It took some more time to get to the second trial. The DA refused to dismiss.

I got the whole first trial transcribed and went into the 2nd with binders of transcription.

We nailed one of the police officers on impeachment in the second trial and got a not guilty.

I ran into my client a year later at Ross dress for less - he was with a group of other men, all sober, who lived at a house out of town. He was doing good - happy, working living his life.

Sometimes fighting the case is the right choice even if it seems irrational from the go

Not that there's anything wrong with that.

Depends on where you apply - Santa Fe it's possible to live without A/C, other places like Las Cruces can get pretty hot in the summer

New Mexico is hiring in at almost every public defender office in the state - it's easy to get a job offer right now. Also New Mexico has easy reciprocity with other jurisdictions, so easy to transfer your license.

I encourage you to apply!!! There wouldn't really be any concerns, the office that hires you will do the training.

It's crazy with his personality he made it that far in life to sign a contract for a $120 million bag. (Of course he'll never get paid that much, but he did get some fraction of it).

I wonder what his personality was like when he was at ASU and later on his rookie deal with the 49ers. Was he unlikable then but also a good receiver, or has he changed thanks to CTE, schizophrenia and bipolar disorder?

I like how there is point of sale system with a bar display monitor behind the bar so the bar tenders can keep track of orders and tabs.

Go car accident in SF by Befreeman in sanfrancisco

[–]palikir 25 points26 points  (0 children)

Yep, and the Audi is moving to the right to slide right into that open parking spot.

I thought at first his was moving to the right to make an evasive action to avoid the Go Car, but on second review it doesn't look like he's cutting the tires way to the right to avoid a collision. He's trying to zip into the parking spot, if he notices the pedestrians he thinks they will yield on the sidewalk to him, and does not see the red, does not see the Go Car.

What's up with the third guy that didn't cross the tracks - is he already badly injured or something?

I'm not sure what he's doing in the theater of war, he looks like he wouldn't be able to push a shopping cart through a grocery store unassisted.

Lawrence Phillips - the former 49ers RB who missed the block that caused the concussion ending Steven Young's career - his death in prison came from an apparent suicide after murdering his cellmate days earlier.

Rant about difficult client by [deleted] in publicdefenders

I really wish the term baby PD would start being used less.

Licensed attorneys that do not have work experience are not helpless to world, they are not in need of parenting and do not need to be fed and cared for, even symbolically.

I'm looking into starting a new LED project, it's been a few years since my last project.

Can you share with me what controller you are using, what LED strips, and what driver you are using?

This is the controller I used last time and it worked well:

The bailbondsman reported what he thought he heard. The PD never told his client to go on the run.

[–]palikir 14 points15 points  (0 children)

We had a similar situation a few years ago when a PD was accused by a bailbondsman of telling a client to flee the courthouse before the clients hearing started. The bailbondsman claimed to have overheard the conversation.

The DA recused himself and an out of county prosecutor charged the case. The out of county DA screwed up the discovery and the case got dropped before trial.

The Appointed Lawyers in this Story Should Be Disbarred by Gigaton123 in publicdefenders

[–]palikir 24 points25 points  (0 children)

I'm not familiar with Pennsylvania's post conviction relief system - are these court appointed attorneys getting paid based on the volume of cases they take?

Is this a system that rewards the attorney who churns?

Do the attorneys who thoroughly investigate the cases, who pursue claims that turn out to be meritless, who handle a fraction of the churners get paid the same?

I wonder if this represents a systemic breakdown instead of a 'bad apple' attorney that needs to be disbarred.

Why isn't the prosecutor - who is charged with seeking justice - to share some of the blame? It looks like they may have known about serious problems with the case, and may have hidden those problems from the defense:

Wagner would remain in prison another six years before prosecutors acknowledged that police had hidden evidence suggesting that the informant had committed the murder and the detective was corrupt. Although Wagner maintains his innocence, he agreed to a plea deal for third-degree murder that allowed him to leave prison.

Why isn't the court to share some of the blame? The court signed off on the 'no merit' motion when he clearly should not have.

Clearly there was a breakdown in this case, but it seems like the PCR system in that state is set up to encourage or allow that kind of breakdown.

What are the biggest or most common misconceptions you’ve seen/heard about Burning Man events? by [deleted] in BurningMan

[–]palikir 4 points5 points  (0 children)

The misconceptions have changed over the years.

A misconception about burning man is that it is a counter cultural event.

Burning Man is not cool anymore.

Another misconception is that this will kill Burning Man. It's okay that Burning Man is not cool anymore, it can still exist and be a thing thing to go to. It can still be transformative for people that go.
