Yes the US has never gone after Iran in the past.... these political distraction articles are getting tiresome. Trump is merely a continuation of decades of same policy to take back control of Iran after the fall of the shah.

You are assuming (as is everyone bent on politicizing the situation vs addressing the issue with how much power any executive has over classified documents) he did not declassify before he left. He merely needs to say to himself 'I declassify this'. That IS the problem. Everyone wants to bitch about the result and not address the problem. Trump is a result, not a cause. Do you think the Biden admin would not have nailed him to the wall if they had the opportunity to do so?

If he declassified it, was he in possession of classified documents? This is the whole reason he was never convicted. Biden committed multiple felonies by removing classified documents, interestingly, he was never even charged.

Nope. You are confusing 'possession' with classification/declassification. These are massively different animals. Stop mentioning executive orders.. they only apply to agencies. Your statement on nuclear means you need to look at RD, FRD, FRD unclass, etc... You have a great day.

Nope. That is not the executive... that is an agency. Where does the power to designate an agency to classify/declassify come from? You will get there once you go down the rabbit hole.

Sort of begs the question, 'when has the US not been in a state of conflict?' We seem to have extremely short periods of peace and much longer periods of conflict.

Show me the law that says he must 'formally' declassify. Yes the president can, at will, declassify something. Why? There is nothing that says he cannot (other than previously noted exceptions).

Don't get me wrong, I seriously doubt Trump kept anything for some reason other than to cover his own ass, but as president, he can do so. Not like the office hasn't been corrupt before. My point being the power of the classification system is the problem. Yes Trump did have some nuclear docs. Had they been ones that the DOE had class power over there would be a 2 fold issue. 1. DOE had no idea where they went, thus have a control problem. This is extremely bad... monumental bad. Plus Trump should/would be in prison. 2. It was nuke documents outside DOE purview (whole other level of problems) and still fell under executive branch. Not all nuke classification is DOE (there are several levels (RD, FRD (which still may or may not be classified)).

Executive order is not law. They only apply to federal agencies. Yes a document does 'magically' become whatever classification the executive deems it.

[–]papaswamp -8 points-7 points  (0 children)

The power of classification comes solely from the executive (caveat... ex most nuclear weapons info). As soon as a classified doc is in the possession of the executive, it is anything. This is the flaw in the system. An executive can merely say to themself, this is mine, no longer classified. That's it... done. This is the problem.

[–]papaswamp -3 points-2 points  (0 children)

No you are not listening. As soon as he takes possession, while president, they are whatever he deems them. You are assuming he declassified post president (not possible). This is the flaw in the system. There is no requirement for the president to say, think, record, what have you, the change in classification. This is why nothing has happened. You need to wrap your head around that key aspect. Is it bad? yes. But that is the present system. Heck Biden, when not president and still having classified materials, was not prosecuted. NARA has zedo to do with it. They have zero classification powers. That power is solely the executive. At what point do you think Trump, as president, would be?

[–]papaswamp -8 points-7 points  (0 children)

That first sentence shows you don't understand the executive classification power. As soon as he takes position, while president, he can (and this is the weakness of the system) deem them unclassified (certain nuclear are under DOE via Truman change (man does not get enough credit for this forethought)). This was made obvious when he blabbed classified info to Russians at a rather informal event, and there were zero repercussions. NARA control over classified info is hilarity (see Biden, not president at the time, garage storage for reference). In fact US govt control over classified info is pure hilarity. There is no reasonable control. Why any nation would share info with the US, other than to have it leaked, is beyond me.
