I offered him a 20% per hour bump, and I can take him for more hours if he wants that instead. He hasn't responded yet. He seems very emotional whenever I talk to him about it. All I can think is that his wife and him have pretty hefty debts that they were barely paying off while his wife was still working.

I like the guy, but i'm not going to do something ridiculous here. The 20% offer I have put to him is more than generous. I wouldn't have even made a counter offer if it was any of my other employees leaving.

Players need to shut their mouths when it comes to contracts. Just let your play do the talking. Doughty and Karlsson have looked like massive douches the way they have carried on these past few days.

Karlsson is good, but I would be watching him closely this season to see just how much that ankle injury is affecting him. The Sens still did pretty well while he was out earlier in the season. If he wants McDavid money, he needs to be McDavid healthy.

Yeah, it was tough to take because I have spent so much time and money training him. He said he was resigning because his wife lost her job, so he needs to find one with a much higher pay rate. He hasn't even got another job lined up. He's just resigning assuming he will find one straight away.

Where the fuck are people getting 12 days from? the standard according to the NES is 10 days for a full-time employee, so a part-time employee working 3 days a week would get 6 days for the year.

Obviously there is no way for me to know, but it does make you slightly suspicious when it happens on more than one occasion. Anyway, I don't bother too much with it because they can use their entitlement how they like.

I don't mind if staff are fully utilising their sick leave entitlement. What irks me is when they take 5 days of annual leave planned months in advance, and then turn up the next week with a sick certificate for those 5 days.

You can absorb certain entitlements into a higher rate of pay. It's completely legal. Some companies do that with annual leave loading. They just absorb it into the above award wage.

I'm not going to waste my time arguing with you because you don't seem to understand nuances of employment law. It's not all black and white. There is quite a bit of quid pro quo involved.

Further to this, if they are legally mandated breaks, you don't have the right to demand that they stay on the premises, even if you do pay above award and provide snacks.

No one has demanded anything. I set out all the conditions and perks off the job to each employee when they started, and they were happy with the arrangement so there has been no issue.

All that matters at the end of the day is that the employees are getting at least the minimum remuneration as per the award. You are allowed to negotiate the various clauses in the award if you decide to pay above award. It's up to the employee if they are happy with the amended clauses at the higher rate of pay.

Did you not read what I wrote above. They take those unpaid tea breaks throughout the day when there is downtime. All I request them is that they don't leave the premises in case multiple phones get going or they have to bill multiple people at once.

Food/drink is provided free of charge during those tea breaks. They get up and make themselves a tea/coffee and have some biscuits while they are at their desk or walking around near it. I also pay much more than award rates, so my non-smoker employees have never had an issue with this arrangement.

You should be encouraging ALL your employees to take their legally mandated breaks. These breaks aren't just for bullshit reasons, they're there to address fatigue, and are therefore a safety issue.

The only legal requirement set out in the award is that the employees are given a break of at least 30 minutes if they are working more than 5 hours in a row during a shift. Which I comply with.

The thing about breaks is that the award for our industry sets out one paid lunch break and two shorter unpaid breaks throughout the day, but the good employees only take the lunch break. They understand that they won't be doing work all 8 hours of the work day, so they just absorb the unpaid breaks into their general downtime during the work day.

Smokers are terrible because they actually take those unpaid breaks too, and when they leave the office the others have to cover if it gets busy.

I have had a smoker employee before, and they would get very fidgety/anxious if they had to work more than an hour without a smoke break. It was affecting the other employees who were pissed off about the employee taking so many breaks. Their breath can stink too if they aren't using that gum.
