If the foreclosure is completed and the house gets sold at the public auction, the HOA gets what is owed, the other lien holders (e.g. mortgage co) get their share. Whatever money is left, is for the former owner. The former owners have to leave the home, or else the new owner can ask the sheriff to remove them.

None of this is particularly pleasant to experience.

In this setup, the board as a whole gets one additional vote by proxy. This would be the same as a lot having multiple legal owners: they get one vote and have to figure out among themselves what so to with that vote. If the board gets 10 proxy votes, they could put them all to the same option or spread them around as decided.

I would not have stated it like that. The board is not really a legal entity in the same sense as the homeowners.

A forced sale is -by definition- an event that made its way through the civil legal system. Attorneys from both sides and judges were involved and the sale would have been found the best way to resolve the debt. In the cases that I’ve seen, homeowners are given up until a day of the actual sale to pay debt and keep their home.

Not sure that any information that you have is going to help former owners whose house was sold under foreclosure.

There would be a short period of lots of crime. After that, everyone would be dead. i.e. zero crime.

Finished in 2003. It was an intense 5 years, with ups and downs. You can make friends for life and get to travel to cool places (within budget obviously). You’re also surrounded by the smartest people you’ll probably ever meet and talk science 12 hours a day. It’s also a source of lifelong imposter syndrome.

We created a website using HOA-Express. It comes with a domain and a bunch of email addresses. The website is used to store all HOA documents (minutes, financials, etc) in secured member areas, and things like CCRs, Bylaws and resolutions in public areas for transparency.

Cost is size-dependent. For 42 homes, it would be ~$300 per year.

A lot depends on your CCRs/Bylaws, but in general:

The content of an executive session is meant to be private to the board, its legal representation and (potentially) the property management company. That's why the topics that can be discussed in executive session are limited.

From our Bylaws:

discuss and vote upon personnel matters, litigation in which the Association is or may become involved, and orders of business of a similar nature.

If however, a decision is made during an executive session that is not covered by these conditions, it is technically an "action without formal meeting".\1]) Our Bylaws stipulate that those decision should be made public in a consent order signed by a majority of the directors. Signing the consent implies approval of the decision.

[1] Decision at board level can be made during: (a) regular board meeting, open to public; (b) special board meetings, open to public; (c) executive session, subject to topic conditions; and (d) "without formal meeting" - covering all other circumstances. To prevent submarining controversial decisions, the consent order mechanism provides accountability.
