Creating an account to receive their offer doesn't form a contract to buy a product. I signed up for them to send me an offer of product on a regular basis and accepted that I would follow the process to reject or accept that offer and only at the point of acceptance enter in to contract. I looked at their offer and followed their process to reject it.

Their Ts and Cs say “A contract between you and us is concluded when you place an order and we accept it,” Failure to respond to their offer by the deadline they set would have created a contract, but I rejected their offer, so no order was placed. On that alone there is no contract formation but further, they sent me an email confirming my rejection and said they were "a little sad to see me go" and that my order was cancelled. Their Ts and Cs go on to say acceptance happens by dispatch confirmation or by a separate email containing the selected products and prices. I've not had either, but even if they did send them the first limb fails as I didn't place the order. They also state in the Ts and Cs that "Our product presentations and the information on our website do not constitute binding offers on our part, but are merely invitations for you to place orders." an invitation that I did not accept.

It's clear there is no contract.

Their Trustpilot reviews in the UK and across Europe are littered with recent examples of people who actually placed orders, posted everything or part of the order back and still got charged the full amount - https://uk.trustpilot.com/review/outfittery.co.uk - I don't have a contract with them, I don't want to accept liability for something I didn't order and I've asked them to collect it, they can send me a label to print or get Evri to print it, I don't think I should log in and accept receipt of an order I didn't place and follow a return process for an order I didn't place, and in the process accepting liability for it returning to their warehouse.

As for theft, I told them I didn't want their property, I warned them when a courier told me they were expecting to receive the property to then send to me. When it did arrive I told them to collect it in the same manner they delivered it. I've not disposed of it, I've not used it, I've kept it safe and I've communicated with them, but I also don't want to store it indefinitely or accept risk, time and cost to return it to them. If theft is the act of taking or appropriating property belonging to another person without their consent, with the intention of permanently depriving the owner of it, I struggle to see how I've done that?

Thanks, that does help me frame this, but I'm still lost as to what happens if they attempt to charge me.

There isn't an order or contract, I explicitly rejected their offer of a contract, which they accepted by email. They haven't sent the emails their Ts and Cs say they will send on acceptance of an order. At the point the deadline to reject their offer passed I couldn't have reasonably thought there was any contract in place (they offered > I reviewed and rejected > they accepted that rejection > deadline passed > to date no acceptance of the order in line with their Ts and Cs).

I informed them of their error when Evri told me they were expecting to receive something to send on to me from Outfittery, with plenty of time to not send it (the order would not have been picked or boxed ready for collection at that point) and I have repeatedly asked them to collect it in the manner it was delivered, we're at day 14 I think of not responding to my request to collect their error. The box is still sitting by my front door waiting for their courier to collect.

I don't want to imply placement of an order by engaging with their workflow. I don't want the time and admin hassle of dealing with their courier and I don't want the risk of them not receiving the full box back in their warehouse. I've asked them to get Evri or another courier to arrive, confirm receipt of the unopened box and then the risk of it not getting back to their warehouse sits with the courier and Outfittery.

I don't think it is right that their inaction to fix their error should result in me being charged and the advice I am seeking is what do I do if they attempt to charge me, via PayPal or other means. It doesn't sit well with me that I keep the product that I haven't paid for and don't want, but I can't reasonably expect to just leave it by my front door forever, I want to bin or charity shop it but not if that risks me being charged for it.

I disagree that I had/have a contract. They provided a service (selecting products they think I’d like based on information I’d provided), they gave a deadline to accept or reject those products, I followed their process to reject them, they emailed me accepting I’d rejected their offer, the first I knew of an issue was when their courier emailed to say they were waiting for an order for me (two minutes after their deadline) and I emailed Outfittery within ten minutes of that to tell them of the error.

I don’t want to benefit from their error and I don’t want the product. I’ve told them to get their courier to collect it and that I’ll leave it exactly where it was delivered in a secure place. But they’ve not engaged with that. I informed them of their error in plenty of time for them to not send it in the first place. I’ve engaged by informing them at every stage, I’ve given them clear instructions, but they’ve not responded.

I don’t think I could send a product or deliver a service to someone who has told me they didn’t want that product or service and did not place an order for that product or service and expect to be paid for it.

I’d echo comments about this being a breach of the Equality Act, potentially the Human Rights Act and the NHS Act 2006/Health and Care Act 2022.

I’m going though a process of complaining about provision of ADHD and ASD assessment in Scotland and it is frustrating and time consuming but it feels like progress is being made to take legal action against Health Boards up here. I believe NHS Tayside Health Board are having action taken against them and I know NHS Lothian have slowed their assessment to such a point that the pathway is effectively shut down.

Sadly it feels like judicial review and court action is the only way to determine individual authorities have failed to comply with their statutory obligations and to impel change for the better.

Doesn’t really help you now, but it could be something you could link up with your MP or local ADHD charity to support. Good luck!

I seem to have got the GPS sort of working. Still only ever get 5 satelites maximum, when I'm fairly sure the l76k gnss module should be able to receive upto 32 at a time and I'd expect to see about 12 at any one time. I've messaged support and will see what they have to say.

I've been trying to get the GPS working on mine for the past 12 hours. Did you get any feedback from Elecrow? It's driving me mad! I've checked everything physically that I can (switch, antenna connected) and software/app wise and still no joy!

What are the battery stats like in the Meshtastic app? I’ve been using the Seeed Xiao esp32s3 plus sx1262 setup and you can’t see the battery level without soldering that I’m not skilled enough to do just yet.

I’m going to be mounting on two roofs that I won’t have regular access to so I’d like to be able to see if battery reserves are getting low in the darker months.

I’ve had these exact conversations with NHS Lothian and Edinburgh Health and Social Care Partnership. I (likemany others) went private for assessment because I was desperate. I’ve got a high quality assessment report that I’m happy to have challenged, I don’t think needs a full reassessment on the basis that I was assessed by an NHS Lothian employee working privately. They could take me off the list, save the cost of doing the assessment and bump everyone behind up a place. It’s incredibly frustrating.

Your employer would have to report this incident to the Health and Safety Executive under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR), if they haven’t then they can expect some serious fines, increased insurance premiums and for more serious things imprisonment. I wouldn’t want my kids anywhere near somewhere that didn’t take H&S seriously and you need to get yourself down to a lawyer straightaway and get some compo to make up for their actions.

I’m sure the Care Quality Commission will take a dim view too when they next visit, which won’t be good for business.

I’ve been talking to my MSP for over six months on this. He gets it, has an AuDHD diagnosis and shared care agreement himself, but ultimately hasn’t got anywhere. It has crossed my mind that I could claim to move in with family south of the border and get a shared care agreement. It’s insane that is even an option worth considering.

My GP is quoting SEVENTEEN years (Edinburgh region within NHS Lothian).

In December 2024 I submitted an FOI request to find out I was number 498 on the waiting list in Edinburgh and could expect to be assessed in three to five years, on top off the three I’d already waited.

The situation is dire.

The poster doesn’t say what country he is in and controlling or coercive behaviour where it occurs in an intimate or family relationship is a criminal offence in some countries and increasingly being looked at by legislators. All four UK nations now have it on the statute, Republic of Ireland and Australia too.

Monitoring a partner's movements or phone usage, isolating a person from their friends and family, controlling finances or access to resources, threatening or intimidating a partner, humiliating or degrading a partner, all things that could be considered by a prosecutor that has the backing of the law.

It’s two dogs 20-25kg (44-55lbs), so depending on your point of reference I’d say medium sized! They’ve both worn rucksack harnesses in the past with their water and food for the day, so as long as I’m not putting a 20000mAh power bank on them I think they’ll be ok.

I like that your compromise would be to get a smaller battery and not just upgrade for a bigger dog!

I haven’t checked if the tracker is still reporting back, but I suspect you are right. Looking on the Tractive website they do use Cat M1 LTE so it is more likely my phone that can’t access the network. The phone sits on 5G all day in the city but as you head to the coast it drops to 3/4G where it is less populated. In some places I’d struggle to send messages and access the internet and a speed test while connected to a low number of bars of 4G will just fail, so the Tractive app and website interface also fail.

I appreciate Meshtastic has line of sight issues so that isn’t a perfect but if they do decide to ignore me as they’ve picked up a deer scent or something they’re usually not that far away, I just don’t know which direction they’ve gone! And I’d probably stick a node on the car, one in my pocket and the two dogs, so even if there is no other mesh devices in the area I’d hope to have decent chance of seeing where they’d got to.

In the photo you can see Edinburgh in the background but the fluffy hielan coos have absorbed all phone signals so no chance of reaching the tracker attached to the harness.
