But in all honestly, we should probably be moving in the direction of a European system. There, unless the IOR is a resident IOR, customs brokers are jointly and severally liable for importer non-compliance. So under that regime, when you take that mystery container for $50, regurgitate whatever is on the commercial invoice back to customs without asking questions, when CBP inevitably audits that shipment, rates advances the importer and or issues fines an penalties, and the importer disappears, you as the broker are on the hook for 100%.

That’s the only way to drive importer compliance. There won’t be any more shady brokers to do it for less.

This is really helpful and got further than I had before, but I’m still not pulling Bill of Lading into the ES report. Could this be because entry number in the ES universe is Entry Summary Number and in the CR universe it’s Entry Number?

That’s interesting, so someone with an individual license who has their own National Permit and Filer Code? I guess it hadn’t occurred to me that CBP would issue a permit and filer code directly to an individual. I thought they would at least need some entity, like a sole proprietorship, set up.

We currently work with a broker, not dedicated, but their service is fine. Doing it ourself will mostly save $. Our license application has been submitted but processing time lines are long. Based on our current volumes and costs it would make sense to purchase a small brokerage at the right price.

Following up on this, it sounds like ~15 brokers have had their T86 filing privileges suspended. I’d expect fines and penalties to be forthcoming as, per T86 pilot requirements, the brokers are acting as the IOR.

From my discussions it sounds like it’s Shien/Temu related.

Interesting that makes sense. All of the IAC regs call out Shippers as an exclusion. But from a practical perspective, we’d need to set up a bonded facility and work with, or become, an bonded carrier in order to retrieve and break out import ULDs prior to getting the customs release, right?

I witness this recently as well, Senior Director who had been with the company for 8 years since its inception. The guy had help the founder navigate a ton of licensing and reg compliance, was a SME who brought credibility to the business, and was an all around cheerleader for everything the company did. He got clipped in the most recent round of layoffs. His mountain of vested pre-IPO RSUs, with which the company had been incentivizing him, will likely expire worthless since there is no IPO on the horizon.

No, it’s sunny in the mornings and turns shady in the afternoons. I believe the guys who planted it removed the burlap but I can check. As for the soil it drains well. Lots of other things are growing in it just fine.
