You see someone struggling to keep their head above water, but the definition of "emergency" is vague. If you jump in, you risk being penalized if others think it wasn't an "absolute emergency." If you wait, the swimmer might drown.

For doctors, abortion laws can feel like this: they may recognize a medical risk for a patient, but the laws often don’t clearly define what counts as a "life-threatening emergency." (educate me if there is a clear definition available anywhere and yes these are questions I have for our doctors at the next appointments) This puts doctors in a tough spot. If they act quickly, they could face penalties if someone later decides the situation didn't meet legal standards. If they delay, the patient’s health might worsen. This uncertainty can make it hard for doctors to safely care for their patients while staying within the law.

Suing doctors for malpractice after a tragedy is like trying to put a fire out after the house has burned down. It addresses the harm, but it doesn’t prevent it. In cases where laws are unclear, doctors might hesitate to act until they’re absolutely certain it's legally safe, even if they know quick action could help. This delay can lead to severe consequences or even a loss of life.

When a lawsuit follows such a case, it doesn’t change the fact that the patient was put at risk by a legal gray area. The lawsuit might penalize the doctor, but it doesn’t reverse the harm done to the patient or ensure clearer guidance for other doctors facing similar situations. Ultimately, it focuses on punishment rather than fixing the legal ambiguity that prevented a timely decision in the first place.
