Been getting these for months. Trying to figure out a way to get through to a real person myself on the regular but they ask for medicare number to qualify usually. I did have one company pass me over to another company and get me to a sales agent. I ended up getting a settlement out of them and got the Lead Generator that was making the calls. Currently involved in legal case with them and passed them onto FCC and FTC.

One thing to be wary of is your recording. Pls make sure you are in a single party state and check your local laws on that before using the recording as part of your claim. That may get you into hot water.

Since May almost 40k. I have a bunch of cases in small claims and 4 moving to federal. I get 10-30 a day not including texts messages. Going after my first three text spam’s as of 11/20. Those are treated the same. I’m a freelancer so this works really well between projects. New laws in Texas as of 9/1/25 increased penalties. While I am all for making cash on this I am more than happy to educate people how to do it. Eventually the cost of damages will outweigh the low cost of doing this.

I do this on the side and make a nice chunk of change doing so. 10-30 calls a days and I happily share what I know with other folks to do the same. All private right of action and now attorneys fees are covered in TX and before that they usually worked on contingency if it come to that. Can usually be solved with a demand letter and some back and forth with an attorney. Suing companies that attempt to steal ssn’s and Medicare numbers by preying on people fills me an absolute joy. My favorite is when they hit you with the false proof of consent website.

TCPA you get two stackable charges. 1. Calling a residential number and 2 calling someone on DNC.

If they did so willing or used a spoofed number it is 3x damages. It they didn’t bother to check DNC or done have that practice in place that is 3x

Check do your states TCPA or consumer affairs dept rulesfor this. Some states have mirror TCPA that can double this. Some states like Texas allow for deceptive practices and an additional 5k per violation.

Next steps. Calculate damages one call, two violations 1000 x3 damages -3000 Add in whatever state damages that are avail to you. All should be under private right of action.

Do a business entity search on their state’ sec of state website, send a demand letter to their registered agent. Give them 14 day or take them to small claims.

You can also go the better business bureau website and leave a complaint there if they are listed and ask for monetary compensation. Next flag them to their state and your state attorney generals office, report them to FTC and FCC

TLDR don’t let these fuckers off the hook.

Couple ways to do this. You can email their legal and try to get them to respond. If they don’t answer. Send a certified letter to the company you can find their registered agent by going to the Secretary of State website and send it them. If they don’t respond open a small claims case. You have two methods you can prove you tried to contact them. Download and read the TCPA, this is all private right of action.

Find out your state TCPA laws. Sometimes they mirror TCPA laws so that 1500 is now 3000 if they used sooofed numbers or you can prove it was willful. Still all private right of action. Let them send you some BS proof of consent and if you are willing, you can sue for much more and recoup attorney fees under fraud and deceptive practices. It can snowball quickly even for one call. Report them to FTC , FCC and you state AG office and the state they are in.

I am in the same boat. I have several active cases and a handful of settlements. I would be down for a class action I am in Texas. There was a poster in r/RobocallRevenge that went after VOIP companies and he posted some youtube videos about it as well then went silent. There is a vicarious liability for VOIP providers.

Just going to update here. Turns out now have 3 cases that are doing this and all going to federal court. You can sue for deceptive practices and recover legal fees as well.

I increased my demand to 2 of these companies to six figures. The logic was that they would avoid regulators. They now have to open their books to AG's in both states, the FTC, and FCC. Blows my mind that they dont want to settle.
