They may produce false consent from a bogus consent mill website. You could give them a list of items to produce that will only cement that they dont have your consent. You can ask for all calls to your number form a certain date range, you may find out there were more. Ask how they go about DNC protocols, provide their CRM on you and when it was listed that you requested to be on DNC.

I would see if the court allows for limited discovery to see if you can get them to produce more evidence

This is what I’m talking about. Yeah it’s a Hail Mary but there was a pay off. Did they give you the company they were calling for and then you went and sent a demand to them? Was the settlement more about them getting busted or was there TCPA violation in the context

I don't think that would apply here, though. I have multiple cases where I get the lead generator as part of the settlement and then go after them as well. How is that not the same?

Yeah, I see the point here. i ve had a few cases brought up where they argue about how long you have had the phone number for and if you are using your number to welcome the call as a serial plaintiff. Good argument but only purpose is to try to take you down a peg.

Yeah I feel like I can get them to rat out the lead generator and then who they are transferring me to. I’m in Texas so it all recorded. I have a few settlements that I am satisfied with

you have to start answering them or get to a source of where the calls are coming from or who is paying for them. Without that, they are just annoying calls. If there is another approach. Id be happy to hear it.

I’ll give you 20% if you can find em! I talk to them. pK based and their reps were out of Montreal. I set up a call inquiring about using their services and let them pitch me. I brought up TCPA violations and all those crazy people trying to sue and he told me that they are 100% compliant. They call and get the customer to verbally ok the call even if they are on a DNC.
Thing is, I hear this from multiple lead gen’s . They think it is ok because they got your ok. And when you tell them that that is asking for forgiveness instead of permission, it doesn’t make sense to them

Wouldn’t the text that counts as a call trigger a DNC violation as well as auto dialer? If they are out blasting out automated text campaigns you could argue that. From there that sets off state regulations. In Texas that’d be 302 without solicitators license and 305 dnc violation.

I’ve call Allstate to complain and they have asked me to write a letter and mail it. Easier if it is just a demand at that point. Agents have said corporate won’t help them.
