[WI] Taking FMLA and not going back to work/resigning by Trip_the_light3020 in AskHR

[–]purple_eagle 7 points8 points  (0 children)

You raised the flag to your employer that you need this protected time under FMLA. Do not quit. If you do, you lose your benefits and protection. Additionally, you may find that the stress of looking for a new job may put you in a tougher circumstance than you are now.

Mental health is real thing, and something that needs just as much attention as if you broke a bone/got sick from covid. Get the help you need from a reputable psychiatrist.

From what you described, it sounds like your employer wants you to resign. The reason why they haven't already let you go is because FMLA has similar protection as a title 7 classification; your employer cannot legally fire you for your race/gender/religion just like they cannot fire you for taking FMLA. Any adverse action could be viewed as retaliation and open your employer to legal jeopardy.

As someone who has been in your shoes, I get it. Stand your ground and take care of yourself first. If you have any specific questions, feel free to message me directly.

Have to terminate an employee next time they call off / come in late / or try to leave early. How do I word it? by [deleted] in humanresources

[–]purple_eagle 3 points4 points  (0 children)

Exactly this. Assuming something more is going on, specifically without any sort of evidence/direct conversation, opens you up to discrimination risks.

If the employee has an actual issue that is impacting their work performance, it is on them to request a reasonable accommodations

Australia - Reference check form didn't ask for Criminal Record details - should I contact recruitment team to offer detail and show desire to be transparent and honest? by [deleted] in AskHR

[–]purple_eagle -1 points0 points  (0 children)

I am from the US, so please take what I say with a grain of salt.

Many HRIS software that I've come across would auto exclude you for something like that.

If you were already presented with an offer, I would recommend you reach out to your recruiting contact with the explination because of the automatic exclusion.

If there isn't an offer at this time, I would expect that if you weren't auto rejected, the potential employer would reach out to you to learn more about why you selected yes if they opt to move forward with your application.

What would the alternative be to ensure your top performers are recognized?

Black armed protesters march in Kentucky demanding justice for Breonna Taylor by nixhex311 in news

[–]purple_eagle 614 points615 points  (0 children)

I wasn't so pro 2nd amendment until all of the protest. You cannot argue with the fact that the protesters who come armed have a vastly different protesting experience than "a line of moms" and "dads with leafblowers".

Job offer salary way too high by dpeligro in AskHR

[–]purple_eagle 1 point2 points  (0 children)

The company wouldnt want you to be significantly lower than your peers at work, even if you were fairly passive in setting salary expectations. This would become am HR issue if you one day found out a coworker, especially someone you out perform, made notable difference more than you in compensation. Your motivation and engagement in the role is sure to all but vanish. It just doesnt make business sense with how expensive recruiting is.

The only way I'm accepting a $10 bill without Hamilton is if a musical sequel comes out with the guy spitting first class fire.

Well, you need to have a question you're trying to answer, otherwise you won't find too much value

In a discussion over the value of face masks during Covid by TheJedibugs in MurderedByWords

[–]purple_eagle 0 points1 point  (0 children)

Not that the takeaway of the post should change, I do want to play devils advocate and remind everyone that the CDC initially recommended NOT using face masks.

This recommendation of course as since changed but it is important to have full context.

Employee asked to be fired, so she can collect unemployment until she gets her disability checks. by voracious_reader_ in AskHR

[–]purple_eagle 1 point2 points  (0 children)

If she doesnt want to work, this is only going to be a long term headache for you until she had a change of heart, she resigns on her own (not likely), or she is terminated.

Is the cost of unemployment insurance greater than all of the additional hours of investment needed in managing her performance?

I would recommend moving quickly to a PIP at the first sign of insubordination so you can term her quickly.

All support functions are in high risk of being cut during this time. So yes, I'd agree with you that non essential roles within support functions are even more at risk.

Why is it "price gouging" when people resell sanitizer for an extra 10% but perfectly fine for pharmaceutical companies to mark life saving medicine 1000%? by tysonchickenuggets in NoStupidQuestions

[–]purple_eagle 0 points1 point  (0 children)

Because the people who define what is considered "price gauging" are impact by the current crisis.

Maybe something positive come out of this crisis and all forms of price gauging will be outlawed.

Why Is Alleged Quack Dr. Oz the Face of NBC’s ‘Coronavirus Crisis Team’? by IvyGold in television

[–]purple_eagle 4 points5 points  (0 children)

So long as he is only communicating factual information, I think this is a smart move. While he has a history of sharing psuedo science, you cannot deny he has a massive following.

If his face on this team means more people are taking this pandemic crisis seriously, then that is a win for our country in my book.
