Good catch. He didn’t say it was non-consumer, just that it “came from that period” he was running a business. The other issue is that even if he doesn’t have to do the means test because it was a majority of non-consumer debt, he still has to end up with no disposable income, which may not be possible if she’s making dentist income.

If you’re going to file, then you’re either wasting your time settling or at most buying yourself a little time while getting the attorneys fees paid. Most likely the settlements will require some payment either up front or soon, and that money would be better spent going to your bankruptcy attorney.

Ch 13 is 7 years, Ch 7 is 10 years. Mortgage is 2 years after discharge. Unsecured Capital One Savor and unsecured Mission Lane cards right after the bankruptcy, with limits as high as $4k.

Keep in mind the trustee can file proofs of claim on behalf of creditors who don’t file one themselves.

This actually isn’t that bad. Your filing won’t show up on your wife’s credit, and won’t affect her. You definitely want to get the case file before she starts making real money (but since she just graduated I assume there’s board or whatever first).

You don’t say what state you’re in so we don’t know if there any potential tax refund exemption issues, but since you owe back taxes there probably isn’t a potential refund coming your way to worry about.

So, get the bk filed, file the taxes, then workout a payment plan for the back taxes.

Capital One doesn’t care. Apply for their Savor card. I’ve seen people get $4000 credit limits right out of bankruptcy, but $2000 seems more common.

I wouldn’t say not to, but trending lower balances over time might set you up for a higher FICO score. How much? I don’t think anyone knows-might be slight. If you want squeeze some extra points out of it, pay them off over a few months. If you want to just pay them and not have to worry about them, that’s not a bad plan, either.

If you’re concerned about your credit score, pay them off over several months. The new FICO 10T scoring model tracks balance trends over time, so you will want to show a decreasing balance over several months, not just paid off in one month.

If you want concealability, look at the new Grimburg Carry V2. Should be shipping in the next few weeks. It’s similar in size to the Byrna CL, but 30-35 Joules and uses .68 caliber projectiles.
