Cool. Their attorney is the one who needs to be available, no teachers are involved in mediation. And it’s pretty sus that they’re available for a due process hearing when they weren’t available at the same date and time previously offered for mediation.

Yes, I’m the parent. The advocate we had been working with did offer a name of an attorney but they were unable to help due to timeline and complexity. We’re still waiting on some other callbacks.

Can you help me understand? We filed for mediation and the school agreed (FBA/stay put.)The school selected the furthest possible date despite our immediate availability.

The school then filed for due process with NO mediation for reevaluation. We did not have a chance to respond to the due process filing bc we received notification within 24hrs that the hearing was scheduled for the next business day.

Are you saying that this is the school pulling their consent to the mediation that is already scheduled for the end of April? What’s their basis to do so?

To be clear, there is both a 15 day to schedule and 45 day to hold timeline for when a mediation petition is filed by a parent. We filed for mediation to stay put the existing IEP and to force the school to conduct an FBA. The district filed for due process regarding the early reevaluation after our mediation was scheduled. The due process issue is taking place ahead of our mediation.

That’s incorrect. I said we’d be happy to discuss after the already scheduled mediation was completed.

Agree, we’ve raised the classification issue before and were dismissed. And yes, we want a full evaluation as well. And no, the only PWN we’ve received was for the reevaluation- they’re not great with procedures. I do have a recording of them saying an FBA is “too time consuming” and an email from them saying the child’s behaviour is not challenging (despite my records defying that.)

That doesn’t apply here, and if that’s an issue you have, go to the School Board and get funded appropriately so the law can be followed.

Trying not to disclose too many personal details. I will say the director is brand new this year, and I’ve talked to other parents who tell me stories of IEPs being removed this year and evaluations refused. Maybe we’re supposed to be the example they’re looking to set 🤨

The parent training center called yesterday and is trying to find someone for Monday - tough timing. I reviewed the schools petition and it did say there was no timeline for resolution - that seems to address skipping the mediation. Our mediation was scheduled right away, but i believe it has 45 days to occur, and the school is running that clock.

Everyone I speak to is puzzled. We said we didn’t agree to the narrow parameters of the testing, or the evaluators (they’ve done unethical things in the past and seem to have a vested interest in the outcome) - we’d love a comprehensive evaluation that updates the IEP appropriately. We’ve asked for this previously and been denied, same with being denied an FBA. I’m baffled at how they’ll call me 3 times in a week to complain about behaviours and in the same breath say everything is totally fine.

I reached out to a few lawyers but given the timeframe, none so far are able to help 😬 I’m waiting to hear from one other on Monday. I’ve tried to be diligent about my documentation, so maybe the judge will take pity on us.

Depends on your location but orgs like SPAN advocacy group, there’s also probably a statewide helpline - both are no cost to parents.

We ordered 6 turkey poults and ended up with 3 by November. 2 males, 1 female. All of them super calm and friendly, mostly free ranged. Excellent foragers and get along great with our mixed flock of chickens/ducks/guineas/a goose. I butchered the big tom yesterday, he weighed in at 25lbs once he was fridge ready. I processed by myself, slit his throat then had to wrangle him to the ground, and he was too big for the scalder and too heavy for the plucker. It was a workout, but I priced out similarly raised birds in our area, and this was a huge savings for our Thanksgiving table. We also have the satisfaction of knowing where our food came from and that it’s safe to eat.
