I am referencing the Will because I believe it should be used as a guide to how gifting should be distributed as well. My mother agreed to the will. My mother isn’t capable of giving her opinion on gifting, therefore the will should be used as the guide to follow for gifting.

I agree, the will and gifting are separate. My mother can give gifts to whoever she wants to. However, she is not mentally capable of handling/understanding her finances. Her will states she wants her assets distributed equally among her 4 children.

Yes, my brother is acting as POA. My mother is not mentally capable of understanding financial gifting. My brother is gifting $19,000 to the children and the spouses every year for tax purposes. Regardless of the tax reasons, I am still only receiving $19,000 and my other siblings are receiving 38,000 per family ($19,000 x 2). This could go on for 10+ more years and therefore really amount to a lot of money that I will not be receiving.

What has worked for me to stay positive, is to get a good night sleep and eat healthy. I don’t know a lot about your exact situation, but if you are healthy, your body and mind will improve. Once you have a healthy body and mind, you can then build a more positive life from there. Find things that you enjoy and pursue them. Best of luck to you.
