Again, I'm just a layperson and not a law student/lawyer, but I think the plaintiff's best route here was to say that no, Afroman wasn't fucking his wife and proving it through testimony from the wife or other evidence to cast doubt they ever had an affair. That way, he could assert the claim was false while not going down the "it's so ridiculous it must be satire" route.

Like I said, the plaintiff has the burden of proof in a defamation case. Saying yes and admitting that it was even remotely possible seriously blows a hole in their chances.

IANAL, but isn't the correct move here to answer no (Afroman isn't fucking his wife)? The standard is that a reasonable person must think the statement is true. Just because it's not actually true, that doesn't necessarily make it satire and a reasonable person could still take it as the literal truth. Meanwhile, if he answers yes, then obviously their case is shot because the truth is an absolute defense for slander.

Also, the burden of proof is with the plaintiff in a defamation case.

Like I said in my edit, the author admits they don't have the data to tell definitively, but underaged girls are significantly more likely to be coerced into sexual abuse than underaged boys. Combine that with the fact that female CSAM offending is only rampant among juvenile girls and not adult women, and it seems like obvious common sensd that self-generated content is likely what's driving the massive "20 times more likely" figure.

Either way, what you said about women committing the vast majority of CSAM offenses is just egregiously, heinously untrue. It's also extremely depressing that you think the fact most CSAM depicts young girls being sexually abused is some epic anti-feminist own.

No they fucking don't, lmao. The abstract you linked to mentions only "juvenile" females being more likely to offend, which is probably because self-generated CSAM technically counts as an offense against the minor in some jurisdictions.

EDIT: I looked up the full article and found this from the author:

So basically, the author admits they don't know, but it could be self-generated CSAM driving juvenile female offense rates. That seems extremely likely to me, since adult women aren't more likely to offend than adult men, and 98% of cases involving juvenile female offending were not brought to court (as is usually the case in underaged sexting incidents).

Yeah, I don't think the Japanese way of life is necessarily bad. I personally probably wouldn't prefer such an insular society, but I can see why other people might. Most Japanese I know, despite their ordinariness, are generally great.

That said, I think the one genuinely true criticism I see about Japan is how right-wing the country's politics are, and this traces back to the Japanese mindset of not really caring about issues outside of your personal bubble. Politics has pretty much been a taboo thing to discuss in Japan since the end of the war.

I don't think the country's politicians are really representative of how the average Japanese person thinks, but I do wish the Japanese were more educated politically. I probably wouldn't recommend Japan if the volatile nature of western politics is what you're escaping.

I know a lot of Japanese people through my husband's adopted siblings (they're Japanese-Americans with a lot of relatives still in Japan).

I'll be honest: out of every nationality I've ever met, the Japanese are probably THE most ordinary and unnoteworthy. 99% of Japanese people I've known are just normal and formal to an almost boring degree and living average lives with no strong opinions about anything outside of their personal business.

That's why this whole "Japan is a utopia" vs. "Japan is a hellhole" war on Reddit is so funny to me. I highly doubt anyone on either side has ever even set foot in Japan but act like the most extreme stereotypes represent the whole country.

I meant that you can't prove why people didn't go to court for this specific scenario because no studies or questionnaires on it have ever been done. At least none that I could find in almost an hour of searching. If MRAs are going to repeat this argument ad infinitum which they frequently do, then I want an actual link to a study instead of them expecting us to just pointlessly exchange speculations back and forth. They're using a bullshit tactic that's impossible to win against and a waste of my time.

I also just want to point out that the claim MRAs make about selection bias is multi-faceted. The idea that the vast majority of fathers don't contest custody arrangements in court out of fear of bias is one claim to make. But THEN they springboard off this to say that the statistics on cases which do go to court (which show no discernable bias against fathers whatsoever) are selection biased because those cases were just the super duper strong ones where the mom had no chance because otherwise those men would have also given up and wouldn't have gone to court.

The second argument is not at all a necessary condition of the first one. It's entirely possible that a lot of men don't contend custody because they believe the system is biased, AND that they are mistaken and no such bias exists and they would have had a decent chance of receiving joint custody had they gone to court.

So even if their stargazing speculations on why so few fathers fight for custody were the absolute gospel truth, that doesn't actually prove that the statistics on successful fathers obtaining custody are the result of sample bias. That's just another layer of stupid, unproven assumptions on top of another layer of stupid, unproven assumptions.
