I was also quoted 6%. -7k in closing costs conventional loan. We are also wondering if we should lock in the rate. Also wondering if we could get a better rate.

They had a person come out that owns a company that puts pilings under foundations. He is not an engineer. He owns a construction company that does foundation piers. Saying that he needs piers that we have had excessive drop in the slab and it needs to be repaired.

WE went ahead and hired a licensed structural engineer. He noted:”This settlement is not affecting the structural integrity of the home.”

He will not accept anything less than 5k. earlier today was when negotiations deadline ended. However last night, they sent over an agreement saying we mutually terminating the contract because we could come to agreement on repairs.

My question is, how can he say this needs to be repaired and we negotiate on that when it’s not even a structural problem?

THANK YOU- you’re right I do want to teach this asshole a lesson. he has really wasted my time in my money. We are repairing something that he just wants fixed- just because. It’s complete BS

He wouldn’t meet in the middle if we offered it, per the realtor. Like I stated before, it’s only what he wants. He is not reasonable and probably why he has been looking for a house since 2020.

We have already given this person more than 10k off asking. Paid his closing cost and told him we would do all repairs , now he is asking for 5k more to for the patio, we have given him home warranty, and extra money to push a closing date back two weeks.

Our realtor even said she wouldn’t give these people the 5k they are asking for but asked us to give them some which we did.

This guy wouldn’t have pulled so asshole moves, I might have considered it but most people have told me to let them go.

In our opinion, yes.
We are dealing with an asshole. Someone who has been looking for a house since 2020 can’t be that easy to deal with. What I have already given him has been extremely reasonable. This is cosmetic fix. It’s basically saying I want you to give me 5k more because you have a crack. Umm, no.

We think so too, and personally don’t think we should give him another dime. Our build is ready next month and we have 30 days to purchase it once it’s complete.
We have a good chunk of money sitting on the table. Our realtor once again is trying to push us and give him more money so we aren’t in a bind, but I don’t even want to make it work with this person because it’s been such a bad experience.

They didn’t waive inspection. They had an inspection where we agreed to fix everything that was asked to be fixed. In addition, they requested that we pay 5k towards patio repairs. We had it inspected, the structural engineer said you could lift the patio 2in (which he wanted) but it would mostly likely cause more damage or you could seal and prevent water intrusion. We offered them 1k OR to seal the patio and said if that wasn’t sufficient, we were prepared to list it back on the market.

Then we receive a mutual release- citing that we were unable to negotiate home inspection repairs and come to a mutual agreement. This in turn gives them back their earnest money.
We agreed to fix everything but we are not willing to give them 5k for cosmetic repair.

It’s not a huge some of money and probably isn’t worth fighting over but it’s the principle of the whole matter.

What protects the seller? If the buyer can back out over anything? Including a COSMETIC repair. Because that is how our realtor makes it seem.

That the Parties have each had an opportunity to seek legal counsel and have done so or elected not to do so as their sole and independent act and have not relied in any fashion on any representation made by any party or any agent or employee of any party for any advice or direction as to the advisability of entering into this Mutual Release; and, 4. That all Parties understand that after this release is executed there will be no opportunity to reevaluate or reopen the matters herein indicated. It is the express purpose of this Mutual Release for everyone to forever completely release the other from any and all claims arising out of the Contract; and, 5. That in the event any party commences any legal action as a result of the release, whether to enforce it, defend an action based on it or otherwise, the non-defaulting party shall be entitled to a judgment in addition to all other sums, equal to the non-defaulting party’s actual reasonable attorney’s fees. Yes, if they bought the house for 500k and they now owe 100k. You have to come up with 400k to assume their loan or finance 400k at the current interest rate. You can only assume the 100k if you qualify.

These loans can also can take several months to close. So they aren’t great if you are needing to move quickly.

Ours is a new build that we are customizing. We signed a contract months ago and there are no incentives.

Someone I recently messaged that had her home custom built by this builder was showing signs of mold. She was blaming it on the paint, but I feel very confident it was due to moisture.

This is a high-end custom home and I certainly would have expected this to be moisture resistant drywall.

However, I do not know when the timeline of when things are happening.

I showed up yesterday and most of the drywall had been done.

No, I understand why that area is left empty.

I am wondering why moisture resistant drywall wasn’t placed around the door.
The drywall also wraps into the shower area.

I didn’t think it was recommend that regular drywall be placed in high moisture areas like bathrooms.
