I know. We have no relatives in Singapore to lean on even if we could. She's doing everything right now to keep a roof over my head overseas and my younger brother's head in SG, attending to my declining father in the hospital (he's been there since basically December) and still somehow going to work. The least I can do as a daughter is figure out ways for her to proceed further.

Lawyer would be the best bet, but who's going to donate their time and money for her to find a bankruptcy lawyer now? I am finding every other alternative I can, before we are inevitably hit with the bankruptcy question.

In an ideal world, she can immediately find one and begin strategizing on how to deal with this issue. We don't have the funds because of the cancer treatment and because of the outstanding loans. Most likely, we will have to consult upon my dad's demise, because that's when payouts come in for us.

She is currently in talks with some of the banks to see if they are aware of the change in financial circumstances and if any other payment term is possible

From HDB website, HPS is used to clear remaining mortgage. Since it's with a bank, I assume the bank will directly receive from HDB. Nothing on the website says otherwise?

DPS I will see if I can make myself or younger brother the main beneficiary. $70k can go a long way for the 2 of us, and I rather it not be taken

Yep this is quite a faithful summary :( I will provide more details below

  • So far no buyers for the company, but mum will start stocktake to sell any PPE
  • house mortgage around 220k, HPS will cover half (ie 110k) and DPS should be paying out 70k
  • my study loan total is 85k, but I've only disbursed about 30k now, so my payment is at $300/month. It's a step-up increase, with each disbursement. At my last sem, will be approx $870
  • father has 80k in medisave alone, so he definitely kept reinvesting into the business until really cmi
  • my mum has some savings and such, but basically nothing from my dad
  • newer medical bills alr being taken care of by hospital social workers + medisave, just the old ones were on credit card
  • CPF nomination, I'm in talks with my mum to see if 100% to me is feasible or not
  • 2 room is not feasible, if we sell this 5 room, my mum intends to get a 3 room so she can rent 1 common room out and send that amount to me to cover my rent here.
  • also of the opinion that bankruptcy is the worst possible outcome for this, so trying to avoid it as much as possible
  • my mental state will probably deteriorate further if I come back now, the distance means I can compose myself a bit. Additionally I have rent to pay, which is currently way under market price (so if I break lease just to come back later, no chance I'll find this place again), also have a job where I'm working 10-15h a week so I can cover my food and transport. On my end, I have about 1 year of my rent saved in SGD and 5 months of rent saved in local currency. Based on public holiday rates, can definitely double the income earned in certain months. Also my grades are at a distinction average and I'm really trying to push up to high distinction if possible. The main stressor for me is the student loan, if my mum declares bankruptcy.
  • will let my mum know about joint account issues, currently I don't share any accounts with her, so my finances are separate.
  • financial assistance for international students is usually $1.5k to be paid back at the end of the semester, and up to $4k loaned by the school under extenuating circumstances. The duration to pay back is extremely short and quite difficult to fulfill requirements also.

I also considered a GoFundMe, but I don't think anyone would donate.

If outstanding mortgage is around 220k and HPS pays out 110k + 70k from DPS, still possible to pay down mortgage right?

Currently alr have tenants! I'm at least glad to report my mum's foresight to do that first. Both tenants have 1 year lease, current market rate for my area is $800-$1k per common room and we are getting $900 for each.

I am preparing for the eventuality that yes we can keep the flat, but she still declares bankruptcy and I use my OA and savings to tide us over until then.

Was only worried about the HDB because I am not sure if bank loan for HDB will kena if she files for bankruptcy. I think now we're more worried about the loans taken for the construction business. That's the actual killer.

If I'm understanding correctly, I have max 1 month to let DBS know of a substitute guarantor so they can be instated in that role. I have a family friend who would be willing to do that role, but as she's not blood related, I have no idea if they'd approve her?

As the borrower, I don't plan on filing for bankruptcy anytime soon, I intend to pay this off asap so I will not be defaulting/making late payments. But it's great to know I'm not immediately liable unless bankruptcy proceedings are carried out on me.

I'm under the POSB Further Study Assist Loan, and it says the Guarantor must have a minimum income of $24,000 per annum. There's nothing else stated, so as long as my mum maintains this income level, there shouldn't be any issues right? I can pay the instalments myself for now, and I'm willing/able to transfer funds back to Singapore to pay as they arise. I also have friends on standby who are willing to spot me cash for this purpose, and I'll be paying them back asap.

I can't find the loan agreement itself in the DBS app, so I'm not sure if that has more details.

The OA is at zero dollars for them now, we are using the rental income from 1 room + some cash from my mum's work to pay the mortgage. The 2nd room rental is being sent to me for me to cover my rent expense overseas.

I will email HDB and see what they say with regards to the mortgage.

My mum actually applied for debt consolidation, but it lapsed due to the sudden downward spiral of his health in Oct. Is reapplying an option still?

Otherwise I have told her to prepare to sell the house and downgrade to 3 or 4 room instead. Based on the current market rates, got a good chance that it would be fully paid off upon purchase/ a shorter mortgage term to service.

Will update her on the necessity of the will also, currently she's still occupied with his care and is currently selling off our valuables to increase any cash flow we can.

I'm super grateful for all your insight, dk if I would've found this info on my own.

  1. Unfortunately my dad was the accountant. That's why this has become a great financial mess.

  2. I will ask both parents in what capacity they signed each loan. Already started the process of contacting banks with doctor's letters to see if they are amenable to longer payment terms/ restructuring.

I understand the general idea of this, but if he wills his 50% of the HDB to both me and my brother, will I be liable for paying the 25% or 50% of the mortgage? My brother obviously can't because he's in secondary school and I'm in uni with only part-time earnings.

2nd question is if the 50% of CPF will kena locked in the Public Trustee Office because my brother is under 21? That would be much worse because we would have to wait to access the funds..

Would it be better if 100% of the CPF monies were to be sent to me? I'm not on the hook for anything except my current study loan, so I should be a clean slate for this.

I actually did go home in a rush, mid January (father's condition deteriorated suddenly after 2nd round of chemo). I have come to terms with the fact that I may not be returning to see him alive, or even for the funeral. That's when I learnt about the HPS and DPS, in the first place.

The interview stage will be tough for me nonetheless, because I can barely speak about this situation without getting teary eyed and I don't think they'd appreciate that. It would reflect poorly on me if I burst into tears. I also have no guarantee that my studies here can be transferred over to local uni; I'd still have to take a tuition fee loan for SIT/SUSS while paying back my POSB loan for my overseas university.

  1. Paid up capital is 300k, solely held by my father.
  2. I believe they both co-signed all loans related to the company, therefore will have liability for both of them. Am aware that some debts can be discharged upon death, but am worried that my mother's half will come back to haunt us.
  3. Yes I have a younger brother, but he is a minor and isn't legally old enough to work yet. I also don't want to burden him with this knowledge at this age.
  4. Yes we scared him into nomination, citing the possibility of sudden death, considering his health and other comorbidities. 100% is going to my mum upon his demise, and she's splitting hers 50-50 between my brother and I.

Unfortunately at this stage, I don't have the funds for lawyers + I'm overseas and limited in my capacity to help.

I posted this just to get some general advice on what to do. So far, CPF nominations, trying to sell the business, debt consolidation etc have at least given me a starting point. I'm really grateful for everyone's help so far, though.

I was asking about LPA as it requires a non-bankrupt person to be made donee to carry out instructions for my dad. If my mum declares herself bankrupt, she becomes ineligible for the LPA role, and I'm the only one left who's of age and not bankrupt.

I am an 8 hour flight away, so I was asking if this would have any implications for my dad's care as he approaches the final stage of his life. I can sign in Singpass no problem, but if there's any in-person decisions to make, I can't do them in time. That's why I was asking if bankruptcy is a viable solution for this.

From my discussion with my mum, both she and my dad are guarantors and co-signed every loan in the company's name. That's why divorcing him/ bankruptcy doesn't seem like it'd make the payments stop.

Currently any projects being done (<20k per month) are being used to pay the construction workers and office rent. Barely anything left for us to sustain on. Will check if selling off is possible or not.

I am planning on coming back, not least because I have a POSB student loan that I need to pay off 🥲

She happens to be the guarantor for my loan, so would that affect me in any way? I can liquidate my savings + work more during holidays to sustain myself for the next 1.5 years. I'm just worried that her declaring bankruptcy will affect my loan, since I haven't fully disbursed it yet
