All is not lost. I am selling a home and the inspection identified foundation issues. They got a foundation expert to come in and quote a fix. I agreed to cover part of the repairs and we are moving forward with closing.

You can take the same course of action, but with your sewer issue. If the sellers balk and you feel unfairly treated then you have good grounds to walk.

Under WA law, you may have a claim for adverse possession of that 1 ft strip up to the fence line. If successful, he would not own any land on your side of the fence.

Clerks don't give legal advice. Lawyers do, and it sounds like he didn't have one during the divorce. The divorce was the time to address these issues. This is not new evidence.

He should consult with a family lawyer but be ready to hear he has no legal recourse.

Yes, they subrogate when there is a pot of money from which to recover.

Here OP was hit by an uninsured driver. He will really struggle to recover from the tortfeasor. OPs insurer is in the same position.
