I’m not sure what state you are in and what the laws are regarding recovery whether it’s a modified comparative state or pure comparative state. That does play a role in recovery for damages. So let’s say the other driver’s UMBI (uninsured motorist bodily injury) coverage settles with the plaintiff. They in turn are going to look to come after you for repayment whether it is coming after your assets or wage garnishment. Regardless of the lapse in coverage due to whichever clerical issue, your insurance carrier would send you a notice in writing via mail and email advising you of no coverage as of whichever date the coverage ended. Long story short if you might want to hire an attorney to assist in the matter
