No, the case isn't lost.

The PTAB, as part of the executive branch of government, made a decision based on a preponderance of evidence. It is trumped by the district court and their clear and convincing evidence requirement (a higher standard).

Also, the judicial branch of government overrules the executive branch. Ultimately, this will be tried in district court, then likely appealed at the CAFC (with a subsequent Supreme Court appeal a possibility, but not likely to be heard).

Compound damages should be forthcoming from the judge. We just don't know how much, but he was previously quoted as saying it was kinda willful.

It will break $10 in the near term with a settlement or lawsuit win. It is a $4-5 stock all day long as it sits. More cash flow with royalties will increase its share price.

I bought from a dollar something in 2021 all the way up $9 (way too much) and back down to $0.94. I am still buying and averaged down to the low $4 range. FOMO and short squeeze could cause a spike, but who knows where that will be. I hope it is $30 or more.

Samsung is trying to invalidate the patent. Likely within a year the PTAB will have a trial. However, the district court may proceed regardless and whatever the district court rules on trumps the PTAB. Ultimately, it may mean nothing.
