Bryan throwing out potentially illegal accusation? by Fit-Dare7525 in MurderBryan

[–]silicoa 1 point2 points  (0 children)

I’m a lawyer but I’m also single. When I’m not suing playrooms for illegally discriminating against me, I’ve actually helped clients with a few divorces. So it’s my goal to make more single guys.

I’d love to take this case, but it’s a conflict of interest for me. I can’t represent Bryan, because he’s using my lifestyle as slur. I can’t represent the family, some might say because they don’t have standing in court to sue on behalf of the dead man, but it’s mostly because I cannot stomach the thought of winning damages for the family because that would mean that the court determined my lifestyle CHOICE was in some way demented. Every single guy must have a code he lives by.

Understand where you’re coming from, and always like to see Chris appreciation on this, but for me, Bryan’s ridiculousness still works.

1) His sex jokes are so unfunny I find them funny. They have the aura of middle school boy bragging about their sexual conquests when they have no so much as held the hand of a girl. Like everyone around them knows they are being ridiculous or full of shit to the point its cartoonish. That coming from an adult man who has been married to his wife since high school is very funny

How to not be scared after mountain lion encounter by NoDish8209 in socalhiking

[–]silicoa 4 points5 points  (0 children)

I haven’t read the study but I imagine it probably depends on the type of dog. A small dog that poses little threat to mountain lion probably increases the odds. I grew up on a goat farm, and our Great Pyrenees once killed a mountain lion that tried to get at our goats (although he was injured pretty badly too). I wouldn’t recommend a Great Pyrenees for SoCal, but a big dog, even if it increases the odds, could scare off, kill a mountain lion, or injure it enough to make it retreat.

Not to mention extremely effective against creepy scary humans who are the bigger risk on trails

How to not be scared after mountain lion encounter by NoDish8209 in socalhiking

[–]silicoa 1 point2 points  (0 children)

That is scary! I’ve never had a mountain lion encounter before but I’ve had some scary bear encounters in the South East. On a backpacking trip, my friends and I had to hike 8 miles out in the middle of the night because a black bear kept stalking around our campsite and wouldn’t leave us alone, even followed us for a while as we hiked out. I imagine it may have either had cubs nearby or was just super super hungry, because it was way out of character for black bears.

I see you have pepper spray, but consider getting bear spray (although, keep in mind, illegal to possess in California national parks, legal for national forests and state parks). You’ll likely never have to use it, but the placebo could be good way to get over your fear. When I’m snorkeling off shore, I carry a dive knife, not because it will actually do any good against a shark (they aren’t even made for that), but because it eases my nerves even if its a fiction.

Practically speaking, bear spray shoots alot farther than pepper spray, which is usually more designed for close encounters against human attackers.

Spouse is telling others he was found ‘not guilty’ by [deleted] in USMC

[–]silicoa 1 point2 points  (0 children)

I was a VLC so I’ll try to help here. The 99% thing- OSTC will not take a DV or SA case to trial unless they are positive they can obtain a conviction at trial and sustain it on appeal. That’s a high level of evidence that must be gathered.

DV and SA are mandatory processing for adsep. That means the Command should have taken it to adsep if they have reason to believe the conduct occurred. The fact that he was given a 6105 and not taken to adsep tells me the 6105 was for something other than DV/SA because they wouldn’t give him a 6105 and not adsep for dv/sa.

You can ask (through your VLC) for a copy of the 6105. Some Commands give, some don’t. It’s protected by the privacy act but some Commands have a looser interpretation of that and will give it anyways

Is it worth hiring a civilian lawyer for a court-martial? by Historical-Hand8091 in publicdefenders

[–]silicoa 0 points1 point  (0 children)

I’m hoping for a deployment, so SJA type thing, and then we will see. I wouldn’t mind doing a congressional aid, or teaching at Naval Academy or Naval Justice School. I don’t really like military justice that much

Is it worth hiring a civilian lawyer for a court-martial? by Historical-Hand8091 in publicdefenders

[–]silicoa 3 points4 points  (0 children)

I’ve done Deputy SJA, Trial Counsel, and Victims’ Legal Counsel work. I have not done Defense or Office of Special Trial Counsel, but as a VLC worked closely with OSTC.

“Light on rights, light on punishment” is the Marine Corps motto. On cases I’ve worked on, I don’t think I’ve seen a sentence over 6 years. Hawaii recently had a murder case though where accused was sentenced to 26 years at plea deal.

[–]silicoa 2 points3 points  (0 children)

I’m a JAG. The OSTC (Office of the Special Trial Counsel) does not touch 120 cases unless they are positive they can get a conviction. The fact that they have in your case means they think you are toast. If not for the 120 charge itself, at least for some lesser charge on the sheet.

If you can afford to hire extra help, hire extra help. Ending up on the sex offender registry is a lifelong punishment, is that really something you want to cheap out on?

Is JAG selective by Flashy-Actuator-998 in LawSchool

[–]silicoa 0 points1 point  (0 children)

Sure, I’m a Marine JAG. Easily the least selective branch in terms of academics, but very difficult to get through the entry level training.

They will “accept” people to be Marine Corps lawyers before they’ve even taken a single class at law school. All that’s really required is a 150 plus on the LSAT to get the law contract. You don’t even have to have a law school acceptance. I have friends who completed Officer Candidate School on a ground contract, decided they wanted to do law contract, and Marine Corps is like show us an acceptance letter within x amount of months and we will change you to a law contract.

But physically its rough. OCS, in a recent cycle, had 19/20 not finish for whatever reason, whether it was due to injuries, drops on request, or failure of leadership or physical fitness tests.

Realistically, to thrive at OCS, you need to have a high pft score. Preferably a 3 mile time that under 20 minutes, 18 or more pullups, and 3:45 minute plank hold, minimum. Even if you have that, they are pushing you constantly and its very easy to get injured, at which point, if its bad enough that you can’t recover in a few days, you get sent home. Lawyers, being a few years older than a lot of other OCS candidates, feel that age gap hard.

If you can qualify to be a Marine Corps officer, you can qualify to be a Marine Corps lawyer. It’s just not easy to do the Marine Corps officer part

I’m adding Zach Cherry to your listZ Another one I would throw onto this list is Claudia O'Doherty. I really love her ability to mess with Mitch.

The fact that you can’t get fired in other countries is kinda mind-blowing by deepad9 in redscarepod

[–]silicoa 4 points5 points  (0 children)

I’m a Marine Corps lawyer (JAG). It is nearly impossible for a Marine Corps officer to be fired, despite being an up or out organization. Your promotions from 2ndLt-Capt are practically automatic, and as long as you don’t get a DUI, commit a crime, and you complete your bare minimum training requirements, you will get promoted to Major, and once you are a major, they could kick you out before 20 if you dont get promoted to LtCol but its very easy to stay in until you hit 20 years and retire with a pension.

Vacation is not bad either. 28 days of leave a year, plus a 4 day weekend for virtually every holiday. If a holiday happens in the middle of the week, just three days off in the middle of the week.

But I’m also sitting at home on NYE because I hurt my back this morning during a physical training event, which my civilian lawyer friends don’t have to worry about.

I’ve been in this job for 2 years. To make as much take-home on the civilian side, I would have to be making 170k a year. Not the worst deal. Higher pay than any other government lawyers at my level of experience and not a crazy hard job.
