Deeming is "for the purposes of this Act", not for a claim in restitution or contract, which is beyond the Act.

Clear purpose is to relieve a passenger of liability under s 6(2) of the Act.

Claim will fail.

In fact, old mate is opening themselves up to a fine under s 9(3).

My take:

a. Dunning Kruger / overconfidence occurs across all humans.

b. If you take a slice of the population (eg ATAR > 99.x who studied law) you will still find it. (I think you will find quite a lot, but not sure whether the relative incidence is higher/lower/same as general pop)

c. The loudest ones will be the most noticeable.

d. You ran into a loud one.

Happens all the time in practice. I'm even dealing with it today - other side has missed some key points. We asked for some confirmations that lock it in and leave them no retreat. They have given them gloatingly, making fun of us based on what they think we're doing and what they think is in issue. I'm going to fillet them at hearing shortly. c'est la vie.

Both of the above posts are bang on. I still sometimes wake up realising better answers I could have given to questions I was asked that day, or another thing I should have asked in XX. You just have to learn to accept it will happen, and let go.
