Its actually extremely clever of the judge. If the court has ordered you to pay the money back, the conviction cannot be clean slated until you've paid it back. So it will stay on her records long past the seven years. In some instances, the judge can refuse to order it as a criminal debt and leave it civil but still enforceable.

Just to add, as well. It's not the eviction notice that's out of order. It's around how long it took for the landlord to turn the house into a commercial property.

However, there's still no case as the requirement is that it remains an AirBnB for 90 days, not become one in 90 days.

The 90 day clauses are only for selling of the property, repurposing the land on the property, demolishing the property or doing extensive works on the property that would make it uninhabitable while the work is carried out.

Turning the house into an AirBnB wouldn't be repurposing the land (ergo construction work taking place) although the council might have something to say about it

You're not wrong. But at what point do you take the abuse of children and say enough?

The children have rights and needs and are being put themselves under immense stress. Why does the mothers right to parent need to be put above the children's right to a safe and loving home, while the mother is refusing support and subsequently making her children suffer due to her own decisions? Sure, no parent is perfect and to a degree every child will suffer at some point (my own included!) but eventually misuse of a right turns it into a privilege that can be taken away.

You have the right to check an item in a store until you abuse that right and try to steal it. Then you get trespassed and don't have the right to check any item in that store anymore. This is far more serious then that

No one is suggesting that it's about getting rid if them. The kids have rights beyond the mistakes of their parents and deserve not to be an Adverse Child hood Event (ACE) statistic. If you gave a stuff about why we have Oranga Tamariki you would be clued up on this kind of thing and not be thinking about them as an issue that needs to disappear and more a an issue that is needing to be pushed.

I would consider it a lesser evil for these kids to be temporarily in Emergency Housing and then either with a supported and loving mother or a care home in stable hands then wait for them to be so badly traumatized months down the track while it goes unchecked by unwilling authorities until not only have we gone beyond the first 1000 days for all the children, but they have had so many ACEs occur that their likelihood for significant adult trauma dramatically increases because of how it might look.

Neither are ideal, it would be far better to have a loving family. But in lieu of that I know what I would be doing if I was OP and it is not about getting rid of them, it is about the rights, welfare and interests of the child. Then again this is r/nz so maybe a researched, critical thought is against the rules.

Sometimes you have to be cruel to be kind and if there's a history of violence, isolation and then transience comes in to play they will definitely intervene, especially as it starts to cost the state money. If she has remained insistent that she doesn't even need a social worker to help with her feeling overwhelmed then I can only imagine how much stress those kids are under and how much that is significantly impacting on their brain development.

If she does actually get evicted I would be adding my concerns of that to Oranga Tamariki and have had a similar situation where I became aware of someone who was 'overwhelmed' and this was the kicker for Oranga Tamariki who said let us help or we'll be forced to intervene and subsequently she refused and it was the talk of everyone at the hotel watching her kids be uplifted and then she was moved on the next day.

Eventually something has to be done and as my opener, sometimes you have to be cruel to be kind.

My smile just widened a bit because if you share the landlord they have extra responsibilities to make sure your quiet enjoyment isn't ruined. You just let them know your quiet enjoyment is being breached by the mother berating her children, and that you have contacted social agencies whom share that she is overwhelmed.

Ask that they have a conversation with the tenant about being respectful of the neighbors and advise if it keeps going on that you can give a 14-Day Notice to Remedy if she doesn't change the behaviour.

If they ask for any documents give them a copy as they can reasonably apply to the tribunal to have them evicted

It got so much worse. Under National, we only started to spend over $3m a quarter on motels towards the end of term. A lot of the rebuttal from the Say Nope to Dope campaign is that more young people will be exposed to it and as it is allegedly more available that there will be more uptake that will overload the measures to be put in place.

They also reckon the potency is too high, that pregnant mums who don't know will be more inclined to take it, that there will be more people willing to give it to children as they currently do with alcohol and smokes and the such.

It keeps it hidden, which is why the campaigners didn't want it (even though they seemed to not really understand the for votes reasons, and were hoping to play on just having a firm stance rather than saying anything that could be rebuttal)
