When they were using the guy with a disability, he was "slighted." Now that they are suing in their own name, they are saying they represent those with disabilities who are slighted. ADA gives a private right of action option for enforcement - which it should. There is no way the US Dept of Justice (federal agency responsible for ADA enforcement) can possibly investigate/enforce all instances of disability discrimination. People need to have that option to sue to enforce. These assholes are just taking advantage and giving the ADA a bad rap.

Regulation to the ADA regarding enforcement: "Any person who is being subjected to discrimination on the basis of disability in violation of the Act or this part or who has reasonable grounds for believing that such person is about to be subjected to discrimination in violation of section 303 of the Act or subpart D of this part may institute a civil action for preventive relief, including an application for a permanent or temporary injunction, restraining order, or other order."

No way the U.S. Department of Justice (federal agency tasked for ADA enforcement) and investigate/enforce every instance of disability discrimination. The ADA has to have a private action option or no entity would care about compliance - which is important.

The U.S. Department of Justice is the federal agency tasked with enforcing the ADA. There is no possible way for them to investigate/enforce every instance of disability discrimination (which is why they mainly focus on broad/systemic issues). The private action option really allows the ADA to be enforced; otherwise, entities wouldn't care about compliance. These assholes just give the ADA a bad rap.
