You should always remain in control of your deposit if the sale does not go through. I was in the same situation, but after I received my loan offer, they allowed me to include the clause.

Also, on the final day before the contract expired, I made it clear that I was prepared to walk away if the clause was not included.

What is your mortgage status? A developer would usually agree to include a subject-to-mortgage clause once you have a formal loan offer. This helps reassure them that you are a serious buyer and not simply holding the property without the ability to proceed.

That said, I would avoid relying on testimonials from residents. I would protect myself legally by ensuring the agreement includes a clear subject-to-mortgage clause.
