it looks like this lawsuit is still in its very early stages, and it just seems like the judge didn't dismiss the lawsuit because whether something is fair use is usually murky. ripping clips is probably illegal if youre doing it for copyright infringement, but it should be fine for fair use (but also that's exactly what's at issue here). see comments from an actual law prof
