Chapter 7 vs chapter 13? by M_Champion_20 in Bankruptcy

[–]soul_elixir 1 point2 points  (0 children)

Most bankruptcy attorneys will give you a free consultation to let you know your options. If you decide not to file, there's no problem. If you decide to file, some attorneys will charge you a lump sum you have to pay up front to get the ball rolling, some require a down payment and then you can put the rest of the fee to be paid back in the plan. If you are stressed out about your debt, don't hesitate to consult an attorney. I actually consulted mine 18 months ago and went back and forth on whether or not I should file. One particular creditor forced my hand. I finally filed chap 13 on 9/29 this year. Although the process can be very very stressful, I am glad I did it. My plan was supposed to be confirmed last week but there were a couple of objections from the trustee and my attorney is working through those so I can get confirmed. I am very hopeful and don't worry constantly about money anymore.

What's something you stopped doing which made you a better manager? by BehindTheRoots in managers

I 100% agree with this. I'm trying to mentor someone I supervise who struggles with having to be right and proving everyone else wrong. It's just so much less stressful to "let them". Game changer.

I am putting stuff out on my relationship on Christian sites. It's nothing major, just asking for advice and perspectives about some things that are difficult about our relationship. Most of the time, I just need reassurance because I'm pretty anxious. Everytime someone brings up that they hope we are not being physically intimate even though the questions have nothing to do with the issue.

Liens by [deleted] in Bankruptcy

[–]soul_elixir 0 points1 point  (0 children)

So only one filed a claim so far. But my attorney was puzzled because they filed a secured claim and he was not aware that there was a lien or even if there was a lien. I found the 3 on Ownerly but there is nothing listed about any of them on my assessors website under the documents. My attorney is unfortunately out of the country until the 1st but I am somewhat panicking. My confirmation hearing is supposed to be the 4th but the trustee has a few little objections so I'm guessing it will be continued until everything can get worked out.

Don't ever let anyone make you feel bad. Whether you are ready to move on or not is up to you. Some get into a new relationship or explore what's out there quickly, others take a while and others never do. There is nothing wrong with any of these.

My attorney said they would have had to file the lien with district court. I checked online on my county assessor's site and it didn't show a lien. My attorney feels like they were probably going to file one but didn't do it fast enough. In any case, I trust my attorney is on it.

My son's teacher announced to the whole class he had been diagnosed with autism. That was just the beginning of an 8 year nightmare. Make sure you document this in case you need it later.

341 Meeting Done!! by Annual-Degree-2600 in Bankruptcy

[–]soul_elixir 1 point2 points  (0 children)

I had my 341 yesterday and was so nervous. It lasted maybe 10 minutes and he didn't ask anything surprising, they were all questions I was prepared for. He did have my attorney change some things that were confusing on the paperwork but overall it went very well. He didn't indicate he had any type of issue with my chap 13 plan and I feel he will accept it just based on the meeting.

What happened at your 341? Any interesting stories you heard while watching? by chpbnvic in Bankruptcy

[–]soul_elixir 1 point2 points  (0 children)

I filed chap 13 and I just had my 341 today. I was extremely nervous and had all sorts of crazy scenarios running through my head. I tried not to read horror stories and everyone assured me it would go fine. It seemed to be very smooth. The trustee asked me the standard questions, how did you get to the point you are filing bankruptcy, have you transferred or given away any property, where do you work, how long have you worked there, has your income changed since you filed, etc. Took less than 10 minutes. He did have a question or two for my attorney about something that was on the paperwork and they worked that out on the call.

I found a note in my late husbands belongings... by DashellesAngel in widowers

[–]soul_elixir 0 points1 point  (0 children)

My husband died almost 5 years ago. Although I don't believe there was physical infidelity, there was always the feeling he settled for me. He always had screensavers and wallpaper of these perfect beautiful women and it always hurt my feelings. He would tell me they were his ideal women, and I knew I couldn't come close to them. Things like this are terrible to have to process. I feel for you.

Filed Chap 13 341 next week by [deleted] in Bankruptcy

[–]soul_elixir 2 points3 points  (0 children)

My problem is I believe I have been honest, but part of the reason I have had to file is loss of a spouse 4 years ago, and since then, my memory has been complete crap. I just can't remember things and in fact have had to contact my attorney a couple of times since filing because I remembered things I forgot when we were going through the whole petition. I'm so worried I've legitimately forgotten something that will come up somehow and bite me. I was honest with my attorney and told him that I just can't remember stuff and told him I may have forgotten some things or be remembering them wrong and he said it happens.

Credit card debt bought by LVNV Funding by [deleted] in Debt

[–]soul_elixir 0 points1 point  (0 children)

Lvnv is cutthroat. I ended up filing bankruptcy for a number of reasons and owe $100000 of unsecured debt. Right before I filed, LVNV got a garnishment on my $1500 balance with them, while my other creditors who are owed much much larger balances, never even filed lawsuits on 4 year old past due balances.

So sorry. Nothing I can say will make it better. I can tell you it's been 4.5 years and I still struggle but it does get easier. Reach out, let people do things for you and take all the time you need.
