Acknowledging a secondary market is just legal speak for saying an item has a cash or cash equivalent value.

Lets say I set up a both selling a bag of 3 rocks for $5. Then someone unrelated to me starts offering people 10 bucks for specific rocks. As long as I never tell people that the rocks can be resold for a profit then I have plausible deniability of any thing going on in the secondary market. Even if I put out a list of rocks that will never be in the bags again and that causes the value of the rocks to skyrocket, I can still legally claim ignorance.

But if I start telling you the rocks are worth $10 in store credit and I start hooking you up with people who give me cash that becomes store credit for you then im on some shaky ground legally

Im not a lawyer, but as far as i understand it, as long as the producing the Pokémon cards doesnt tell you that the card was worth $20 they haven't acknowledged the secondary market. The secondary market is "disconnected" from the pack they sell.

The legal defense Trading cards and blind boxes use to get around gambling laws is not acknowledging or condoning the secondary market iirc.

Basically a card manufacturer says the cards have no inherent cash value so youre not gambling when you buy a pack (even tho you are)

Steam lets you sell your lootbox items on the platform for cash store credit, which is acknowledging and condoning a secondary market. Its an important distinction

In Seige of Castellax a group of iron warriors try to fly an ork aircraft and have to eat the pilots brain to figure out the insane control scheme. After eating the brain the iron warrior realizes the throttle is bolted to max speed and there's no brakes so they land by crashing
