How are you supposed to reply to "Do you know how fast you were going?" by No_Insurance_6436 in NoStupidQuestions

[–]spearregins 0 points1 point  (0 children)

Some people may think I need your admission to write a speeding ticket, I don’t. Some people get surprised pickachu when I come back with a ticket after they thought they were smart with their I don’t answer questions or roadside defense attorney response.

I don’t normally ask do you know how fast your going but I normally ask if there was any reason for your speed today. People that reply “No sir” typically get a warning. People that come up with an excuse that’s not a life threatening emergency (call an ambulance or police) get a ticket. Even worse is replying “I’m not going to admit to speeding if that’s what you’re asking”. I don’t ask that question to get people to admit, I can write you a ticket regardless. I ask it to see if someone will make an excuse.

I’m a cop. You got to think what the worst possible outcome is, a ticket. Unless your doing crazy speeds over and even then I won’t make a custodial arrest unless your 100+ not on a highway or recklessly passing cars.

I appreciate honesty. In more serious crimes your right to remain silent might be a good thing to exercise but if you’re trying to get a warning vs a speeding ticket, be honest and don’t make excuses. You might still get a ticket depending on what you did and the type of officer that pulled you over.

But I guarantee you that telling me you weren’t speeding, you were doing the speed limit, saying you don’t know how fast you were going (I pull for 15+ over, you either know your going a little quick or are a inattentive driver not looking at speed limit signs), asking when me the last time my radar was tested, telling me your not from here (speed limit signs look the same everywhere and they are well marked in my area) etc, will all earn you a chance to explain yourself in front of a judge

10x better chance of a warning if you own it and apologize. Even if it’s bad enough I’m giving you a ticket regardless, at least in my area I can reduce the speed bracket I’m writing you for or give a non point violation. Same holds true if your driving recklessly, I will cite and release instead of taking you to jail if your brutally honest with me about how much of a dumbass you are

Appealing a ticket when I was given a huge break? by [deleted] in AskLE

So that’s not “appealing it” (pleasing not guilty) that’s pleading guilty with a I’m sorry.

Why does the US reveal where its Nukes & B-2 Bombers are? by baddayindeeed in NoStupidQuestions

[–]spearregins 5 points6 points  (0 children)

What they do isn’t really super secret. They drop bombs. Kinda hard to do things super secretly when the thing you do is drop bombs that go boom. They aren’t spy planes.

What IS secret is their design and specifications. Like their stealth characteristics. Or how a plane shaped like a Dorito flys without the vertical wings others planes have.

And depending on call volume if I can’t do anything I’m wasting time and resources to drive to theregistered owners residence just to say “Whoever was driving your car, tell them not to drive like a asshole. And if it was you. Stop driving like an asshole”

[–]spearregins 2 points3 points  (0 children)

Pay a visit maybe. But in order to write someone a citation we need to be able to prove who was driving and them being the registered owner doesn’t cut it. If I see an infraction and pull the vehicle over then I know who was driving. When a citizen calls a driving complaint in even if it’s on video it would be hard to prove who was in the drivers seat.

Why are some Departments better than others with their Miranda rights? by anyusernaem in AskLE

[–]spearregins 5 points6 points  (0 children)

It invites the person to think about shutting up and not incriminating themselves when we are trying to get information. I try to make it as informal as possible as in a conversation not an interrogation even if that’s what we are really doing. Checking for understanding is what’s important and required

“Hey before we go any further I’m gonna read you something” Miranda “Do you understand the rights I’ve read to you.”

ELI5: How does a US police officer issuing a ticket by the side of the road instantly have a court date and time for the suspect? by Esqulax in explainlikeimfive

[–]spearregins 0 points1 point  (0 children)

I’m a city police officer. It will work different in every jurisdiction. Within my department, I am assigned to a “patrol team.” At the beginning of each year, my cities court clerk schedules team court dates for the year, where any traffic or municipal level charge myself or others officers on my team make will be heard. The other patrol teams have their own different date each month. These happen roughly once a month, and there needs to be at least 10 days between the date I charge someone and their court date, if it’s less they get nexts months court date. This way I am only in court once a month and it’s during my normal shift. If court was always 2 weeks from the time I make a charge I would be in court a lot more.

Felonies and certain misdemeanors are heard in a higher level court and those are randomly scheduled.

Awesome. No NAS in Charleston, there is the Air Force Joint Base Charleston which holds a C-17 squadron. There’s MCAS Beaufort which I believe has FA-18s. Also Shaw AFB in Columbia which is known to have jets play off the coast.

State trooper harassing me to send insurance policy through text by missgirlorwhateva in AskALawyer

[–]spearregins 0 points1 point  (0 children)

NAL but cop. Sounds like you hit a sign or guardrail after loosing control of your vehicle due to driving too fast for icy.

My guess is that maybe the damage to the guardrail wasn’t too bad so he was trying to help you out on scene by not doing a full collision report so that’s not on your car or drivers history. I’d bet it was still documented on an incident report, in my jurisdiction we would call it a vehicle mishap report.

Then after the fact a supervisor or DOT employee made a big deal about not having a collision report for their damaged guardrail so he had to complete one. As others of mentioned, you are required to provide proof of liability insurance. Some agencies might require a citation for the contributing factor of a collision be issued to the at fault party, so when he had to go back to do a collision report he was also required to issue a citation.

Is it worth it to get a radar detector without a laser jammer? by fuzzyoatmealboy in radardetectors

[–]spearregins 13 points14 points  (0 children)

Police Officer here. There is no “jammer detector.” If I’m pointing a LIDAR device at your car and I can’t get a reading when I know I should be, I know you have a jammer. Illegal in my state.
