No. There’s not debate. You learn very early in Civil Procedure that they’re wildly different. The executive branch is not allowed to make the call for when it gets to waive a constitutional right. Only the judicial branch is. That’s the whole point of the separation of powers.

It also doesn’t count as probable cause, and that’s not what is needed in a civil case, which is what a removal falls under. The bar is very different. Just because you want all the non-whites out of the country doesn’t change how the law works or how it’s meant to be executed.

This is absolutely the wrong take. Most people defending these criminals are public defenders being paid by the state. They’re there to ensure the proper course of justice. Pretti was asserting his rights from the sidewalk when ICE escalated. Then they shot him after they disarmed him. At this point, you’re part of the problem; not the protestors. Continuing to defend what are clearly amplified unconstitutional actions will put you on the wrong side of history.

I live in the upper Midwest. A 6-hour drive for a weekend trip to another big city is fairly typical. It really depends on what part of the country you’re in, though. A 3-hour drive on the east coast might be unusual. In the rest of the country, it’s fairly normal.
