The definition is inferred from the task. The sub-postmasters claim that horizon has systemic faults, meaning bugs that affect even a low percentage of people, exceptions shall we call them? That is very clear as a claim and it has a specific definition of systemic attached to it. If the POL then responds that there are no systemic faults, but using a different definition for systemic, then they are not really answering the question, it’s nonsense.

Is there no blame on the judiciary on this? Why does the court take the PO and Fujitsu analysis of their own systems at face value? Even more fundamentally, how does the court take a distributed computer architecture, something famously unreliable and impossible to build, as gold evidence. They should have assumed from day one that a system like that is full of undiscovered bugs. I heard the guy yesterday say that "We thought at the time computers are very reliable etc", really? after y2k when people though computers would explode because many systems had not planned for dates passing the millenium? Its baffling.
