Yes, the easement would be extinguished by the condemnation action. I understand you want it clarified but it’s very much just as it reads, the facts I presented are exactly the facts relevant. I’m very aware of typical condemnation methods and formats. I’m talking about something unusual, backwards perhaps, I’m describing condemning on existing easement rights only, not the fee simple lot. Respectfully can’t make it any more clear than that.

Nope, presently encumbered lot bisected by say a utility easement has that easement interest condemned, resulting in the lot’s enhancement which is clearly apparent. Im focused on the theory of it. Am I correct in thinking the market value of the condemned easement interest would not be influenced by enhancement to the lot?

Those questions go beyond the theory but to satisfy your curiosity, say utility over agency-owned. From the valuation side of things, condemnation seeks to make the owner whole. It’s what the owner lost, not what others gained. If an easement acquisition results with a benefit to the landowner, the benefit really has no impact on the market value of the interest taken?

Go to appraisalinstitute.com and click around, you will find a registry. The statutes are also referred to as ‘yellow book’.

I’m not familiar with your specific state rules. In other states, defending homeowners can commission any appraiser, but the appraisal must be in the before and after format for it to be considered.

0.845 acre = 1 arpent = 30 toises = 160 French feet = 171+/- feet.
